Compliance with orders and directions SCHEDULE 1 :- Description of Electrical Cables and Wires ELECTRICAL CABLES AND WIRES (CONTROL) ORDER, 1970 S.O. 4093, dated the 26th December, 1970 1. -In exercise of the powers conferred by Sec. 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order, namely : 1. Short title, extent and commencement :- (1) This Order may be called the Electrical Cables and Wires Control Order, 1970. (2) It extends to the whole of India. (3) It shall come into force at once. 2. Definitions :- In this Order,- (a) "Controller" means the officer appointed by the Central Government to perform the functions of Controller under this Order; (b) "dealer" means any person who carries on the business of buying or selling electrical cables and wires whether or not in conjunction with other business; (c) "electrical cables and wires" means the electrical cables and wires (bare or insulated), as described in the Schedule annexed to this Order, (d) "manufacturer" means any person who is engaged in the manufacture of electrical cables and wires by any process whatsoever; (e) "sale price" means the amount payable to a manufacturer or dealer as consideration for the sale of electrical cables and wires inclusive of any charges for cost of freight or delivery, but exclusive of any sum charged as tax on the electrical cables and wires as a finished product. 3. Control of sale price :- No manufacturer or dealer or other person shall sell or agree to sell or otherwise dispose of any electrical cable or wire manufactured in India for a sale price exceeding the sale price fixed in pursuance of Cl. 4. 4. Fixation of sale price :- T he Central Government or the Controller, having regard to the estimated cost of production of electrical cables or wires manufactured in India may, from lime to time, by notification in the Official Gazette, fix the sale price of the electrical cables or wires so manufactured, and different sale prices may be fixed in respect of different types of electrical cables or wires or in respect of the electrical cables or wires manufactured in different areas or different factories. 5. Price list to be displayed at place of business :- Every dealer shall display at a conspicuous part of the premises where he carries on his business in electrical cables or wires, a list of sale prices of the electrical cables or wires kept for sale by him, in such a manner as to be easily accessible for consultation by any customer. 6. Manufacturer and dealer not to withhold sale :- No manufacturer or dealer shall withhold from sale any electrical cables or wires, manufactured in India and ordinarily kept for sale by him. 7. Power to give directions, call for information, etc :- The Controller may, by order,- (a) direct any manufacturer or dealer to maintain such records relating to the manufacture or purchase or sale of, or other transaction in, electrical wires and cables, as the Controller may specify in the order; (b) specify the manner which a manufacturer or dealer shall keep accounts of any manufacture or purchase or sale of or other transaction in, electrical wires and cables; (c) require any manufacturer or dealer to furnish within such period or at such intervals, such information, returns or reports relating to the manufacture or purchase or sale of, or other transaction in, electrical wires and cables in such form as may be specified in the order; (d) give directions to any manufacturer or dealer for the disposal of electrical cables and wires, including sub-standard production thereof, and to the processing of scrap; (e) issue such other directions to any manufacturer or dealer as may be necessary to carry out the purposes of this Order. 8. Power to enter, search, seizure, etc :- 1[(1) Any police officer not below the rank of Assistant Sub- Inspector or any other officer of an equivalent rank authorised in hus behalf may, with a view to securing compliance with this order or to satisfy himself that this order has been complied with, and with such assistance, if any, as he thinks fit- (i) enter upon and search any premises, an vehicle or vessel in which such officer has reason to believe that any of the provisions of this order has been, is being, or is about to be, contravened; (ii) seize any electrical cables or wires in respect of which he has reason to believe that any of the provisions of this order has been, is being, or is about to be, contravened.] (2) The provisions of Secs. 1, S.2 of the Code of Criminal Procedure, 1898 and S.103 of the Code of Criminal Procedure, 18982 relating to search and seizure shall, so far as may be, apply to searches and seizures under this clause. 1. Subs. by S.O. 593(E), dated 6th October, 1975. 2. Now Sec. 100 of the Criminal Procedure Code, 1973 (2 of 1974). 9. Compliance with orders and directions :- Every manufacturer or dealer to whom any order or direction is issued under this Order, shall comply with such order or direction. SCHEDULE 1 Description of Electrical Cables and Wires 1. Bare copper rods, wires and strips of all sections. 2. Braided copper conductors. 3. Enamelled copper/aluminium rods, wires and strips of all sections. 4. Cotton, silk, paper, fibre, glass tape, etc. covered copper/aluminium rods, wires and strips of all sections. 5. Copper/aluminium rods, wires and strips of all sections coated with tin and/or other metals. 6. Copper fuse wire. 7. Copper clad steel wire. 8. Grooved contact wire. 9. Paper insulated lead sheathed cables with copper/aluminium conductors. 10. Rubber insulated cables with copper/aluminium conductors. 11. Rubber insulated flexible trailing cables with copper aluminium conductors. 12. P.V.C./Polyethylene/Cross linked Polyethylene/Plastic cables with copper/aluminium conductors. 13. Aluminium conductors steel reinforced/all aluminium conductors. 14. Coaxial and dry core cables for communication. 15. Other types or cables and wires with copper/aluminium conductor not mentioned above. Note.-For the purposes of this Schedule- [(1)* * * *]; (2) "aluminium" means electrolytic aluminium (IS : 4026 of 1967).
