Appeal EXPORT OF COIR MATTINGS (INSPECTION) RULES, 1972 S.O.1387, dated 3rd June, 1972 1. - In exercise of the powers conferred by Sec. 17 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), the Central Government hereby makes the following rules, namely: - 1. Short title and commencement :- (1) These rules may be called the Export of Coir Mattings (Inspection) Rules, 1972. (2) They shall come into force on the 20th June, 1972. 2. Definitions :- In these rules, unless the context otherwise requires- (a) 'Act' means the Export (Quality Control and Inspection) Act, 1963 (22 of 1963); (b) 'Agency' means the Export Inspection Agencies established at Bombay, Calcutta, Cochin, Delhi and Madras under Sec. 7 of the Act; (c) 'coir mattings' means coir mattings manufactured on powerlooms as well as handlooms and includes- (i) coir matting mats, (ii) coir matting rugs, and (iii) any other sorts of coir matting. (d) 'Council' means the Export Inspection Council established under Sec. 3 of the Act. 3. Basis of inspection :- Inspection of coir mattings intended for export shall be carried out with a view to seeing that the coir mattings conform to the specifications recognised by the Central Government under Sec. 6 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), (hereinafter referred to as the recognised specifications). 4. Procedure of inspection :- (1) An exporter intending to export coir mattings shall give intimation in writing in the prescribed form of his intention so to do to the nearest office of the Export Inspection Agency. (2) Every intimation for this purpose shall be given not less than seventy-two hours before the expected date of shipment. (3) Before applying for inspection, the exporter shall himself inspect the goods carefully and remove all such goods which do not conform to the recognised specifications. (4) The goods shall be packed in rolls or bundles and kept ready in packed condition properly stacked in a well-lighted place. (5) The exporter shall provide the necessary facilities to the Inspecting Officer of the Export Inspection Agency for carrying out inspection to ensure that the consignment conforms to the recognised specifications. 1 [ (6) On receipt of the intimation referred to in sub-rule (2), the Agency shall inspect the consignment of coir mattings in accordance with the instructions issued by the Export Inspection Council in this behalf from time to time, with a view to seeing that the same complies with the requirements of the recognised specifications of different varieties of coir mattings referred to in rule 3. ] 1. Substituted by S.0. 1928, dated 14th July, 1973. 5. Place of inspection :- T h e inspection shall be carried out at the premises of the manufacturer or at the premises of the exporter. 6. Inspections fee :- A fee at the following rates shall be paid as inspection fee for coir mattings and coir mattings mats, namely: - (a) Coir mattings: 2.5 metres and below Re. 1.00 per packet subject in width, to a minimum of Rs. 10 per consignment. (b) Coir mattings: above 2.5 metres Rs. 3.00 per packet subject in width, to a minimum of Rs. 30 per consignment. (c) Coir matting mats Re. 0.60 per packet subject to a minimum of Rs. 6 per consignment.] 7. Certificate of inspection :- A fter satisfying itself that the consignment of coir mattings conforms to the recognised specifications and has been sealed in accordance with the instructions issued in this behalf the Agency shall, within 3 days of the receipt of the intimation and the particulars of the consignment under sub-rule (1) of rule 4, issue a certificate to the exporter declaring that the consignment conforms to the recognised specifications and is export-worthy: Provided that where the Agency is not so satisfied, it shall within the said period of 3 days refuse to issue such certificate and communicate such refusal to the exporter along with the reasons therefor]. 8. Appeal :- (1) Any person aggrieved by the refusal of the agency to issue a certificate under rule 7, may, within ten days of the receipt of the communication of such refusal by him, prefer an appeal to a panel of experts consisting of not less than three persons as may be constituted for the purpose by the Central Government. (2) The panel will consist of at least two-third of non-officials of the total membership of the panel of experts. (3) The quorum for the panel shall be three. (4) The decision of the panel on such appeal shall be final. (5) The appeal shall be disposed of within 15 days of its receipt.]
