SCHEDULE 1 :- SCHEDULE 2 :- Sampling Table EXPORT OF JUTE MILL SPARES AND ACCESSORIES (INSPECTION) RULES, 1979 S.0.939, dated 17th March, 1979.1 -In exercise of the powers conferred by Sec. 17 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), the Central Government hereby makes the following rules, namely :- 1. Short title and commencement. :- (1) These rules may be called the Export of Jute Mill Spares and Accessories (Inspection) Rules, 1979. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. :- In these rules, unless the context otherwise requires - (a) "Act" means the Export (Quality Control and Inspection) Act, 1963 (22 of 1963): (b) "agency" means any one of the agencies established by the Central Government at Bombay, Calcutta, Cochin, Delhi and Madras under Sec. 7 of the Act; (c) "jute mill spares and accessories" means any of the articles mentioned in Sch. I to these rules and meant for use as spares and accessories for jute mill machine machinery. 3. Basis of inspection. :- (1) Inspection of jute mill spares and accessories for export shall be carried out with a view that the same conform to the specifications recognised by the Central Government under Sec. 6 of the Act (hereinafter referred to as the recognised specifications). (2) Sampling shall be done as per the Table mentioned in Sch. II to these rules. 4. Procedure of inspection. :- (1) (a) An exporter intending to export any of the jute mill spares and accessories shall give intimation in writing of his intention so to do and submit alongwith such intimation a declaration as to the agreed specification stipulated in the export contract giving details of all the technical characteristics to any of the agencies to enable it to carry out the inspection in accordance with rule 3 and he shall, at the same time, endorse a copy of such intimation for inspection to the nearest office of the Council. (b) The addresses of the Council and its regional offices are given below : Head Office: Export Inspection Council, World Trade Centre, 7th floor, 14 / 1B, Ezra Street, Calcutta-700001. Regional Offices : 1. Export Inspection Council, Aman Chambers, 4th floor, 113, Maharshi Karve Road, Bombay - 400004. 2. Export Inspection Council, Municipal Market Building, 4th floor, 3, Saraswati Marg, Karol Bagh, New Delhi-110005. 3. Export Inspection Council, Manohar Building, Mahatma Gandhi Road, Ernakulam, Cochin- 682011. (2) Every intimation and declaration under sub-rule (1) shall reach the office of the agency not less than ten days before the expected date of shipment. (3) Before applying for inspection, the exporter shall himself inspect the goods carefully and remove all such goods which do not conform to the recognised specifications. (4) On receipt of the intimation and declaration referred to in sub- rule (2) the agency shall inspect the consignment of jute mill spares and accessories in accordance with rule 3 and the instructions, if any, issued by the Council in this regard from time to time with a view to see that the same complies with the requirements of the recongnised specifications applicable thereto (5) After completion of inspection, the agency shall immediately seal the packages in the consignment in a manner as to ensure that the sealed goods cannot be tampered with 5. Place of inspection. :- Inspection of jute mill spares and accessories under these rules shall be carried out either (a) at the premises of the manufacturer or (b) at the premises at which the goods are offered by the exporter, provided that adequate facilities for the purpose exist therein 6. Inspection fee :- Subject to a minimum of rupees one hundred per consignment, a fee at the rate of 0 50 per cent of free on board value of such consignments shall be paid by the exporter to the agency as inspection fee 7. Certificate of inspection. :- O n satisfying itself that the consignment of jute mill spares and accessories conforms to the recognised specifications referred to in rule 3, the agency shall, within three days of completion issue a certificate to the exporter declaring that the consignment conforms to the recognised specifications and is exportworthy Provided that where the agency is not so satisfied it shall within the said period of three days, refuse to issue such certificate and communicate such refusal to the exporter alongwith the reasons therefor 8. Appeal. :- Any person aggrieved by the refusal of the agency to issue a certificate under rule 7, may, within ten days of the receipt of communication of such refusal prefer an appeal to such panel of experts consisting of not less than three persons but not more than 7 persons as may be consituted by the Central Government for the purpose of hearing appeals (2) At least two-thirds of the total membership of the panel of experts shall consist of non-officials (3) The quorum for the panel of experts shall be three members (4) The appeal shall be disposed of within fifteen days of its receipt SCHEDULE 1 1 Card staves 2 Card, gill and metal pins 3 Sliver cans and its accessories 4 Faller bars 5 Faller bar slides 6 Faller screws 7 Faller track complete for RH and LH 8 Coiler motion five star pinion 9 Dead spindles for spinning frame 10 Spindles for cop-winding machines 11 Spindles for loom 12 Flyers for all types of spinning frames 13.
