Appeal. 12. 12 13. 13 14. 14 15. 15 EXPORT OF JUTE PRODUCTS (QUALITY CONTROL AND INSPECTION) RULES, 1970 S.O. 3396, dated 14th October, 19701. - In exercise of the powers conferred by Sec. 17 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), and in supersession of all existing notifications on the subject, the Central Government hereby makes the following rules, namely :- 1. Short title and commencement. :- (1) These rules may be called the Export of Jute Products (Quality Control and Inspection) Rules, 1970. (2) They shall come into force on the 16th October, 1970. 2. Definitions. :- In these rules, unless the context otherwise requires, - (a) 'Act' means the Export (Quality Control and Inspection) Act, 1963 (22 of 1963): (b) 'Agency' means the Export Inspection Agencies established at Cochin, Madras, Calcutta, Bombay and Delhi under Sec. 7 of the Act; (c) 'Council' means the Export Inspection Council established under Sec.3 of the Act; (d) 'Jute products' means any of the following classes of products manufactured from jute, namely,- (i) "Hessian", that is, a single warp, plain woven fabric weighing from 4 oz to 18 oz a yard (139.5 gm to 434.0 gm per metre) with a normal basic width of 40" (101.60 cm); (ii) "Sacking Cloth", that is, a double warp, heavy cloth, either plain or twill, weighing from 12 oz to 34.56 oz a sq yard (372 gm to 1072 gm a sq metre) of different widths ; (iii) "Hessian" and "Sacking" bags, that is, bags, made from the cloth referred to at (0 and (11) respectively and used as containers for a variety of commodities and shall include jute wool packs and Jute bagging for Wrapping Cotton bales ; 1 [(v) "Carpet Backing Cloth", thatt is, broad-loom hessian of different constructions weighing from 6.0 oz per sq yard (195.3 gm per sq metre) with the width above 104" (264.2 cm.).] 1. Substituted by S.O. 303, dated 5th January, 1972. 3. In-process quality control. :- The quality of jute products intended for export shall be ensured by the manufacturing mill effecting the following controls, at different stages of manufacture, together with the levels of control, as given below : (1) A laboratory and inspection department shall be maintained which shall be suitably equipped and staffed to carry out tests and inspection in the frequency advised by the Council to ensure that the products manufactured conform to the specifications. (2) All records of tests and inspection shall be maintained in the manner prescribed by the Council and shall be made available to the Council / Agency. (3) (i) The tests and inspection, as specified in the Appendices and the Tables appended to these rules and at the levels of control specified therein, shall be carried out on all the production of the mill and appropriate records and charts shall be regulary and systematically maintained. (ii) For the purpose of inspection under these rules all Hessian and Sacking Cloth / hessian and sacking bags / carpet backing cloth of one type and quality manufactured under similar conditions in one single shift of the finishing department shall constitute a control unit. (iii) The material shall have suitable mark of identification so that they could be traced back to the particular machine manufacturing them for taking corrective action whenever necessary. (iv) Tests. (a) Hessian and Sacking cloth as in appendix 'A'. (b) Jute Woolpack as in appendix 'B'. (c) Jute Bagging for Wrapping Cotton Bales as in appendix 'C'. (d) Hessian Bags / Sacking Bags as in appendix 'D'. (e) Carpet Backing cloth as in appendix 'E'. (4) Five reels of jute yarn of one definite type and quality manufactured under similar conditions for use in the manufacture of jute products shall be drawn every two hours and tested for strength. (5) At all stages of manufacture, the factory shall maintain appropriate control and checks to ensure that the product conforms to the various requirements of the appropriate specifications. (6) A separate record shall be maintained giving information relating to the rejection of control units, which do not conform to the specification. (7) If, at any time, there is any difficulty in maintaining the conformity of the product to the specification, or the testing equipment goes out of order, or if directed to do so by the Agency for any reason, the manufacture of jute products for export shall be suspended under intimation to the Agency and to the Council. The production for export may be resumed as soon as articles are passed to conformity with the specifications or the equipment is restored or the Agency so directs. The information regarding resumption of of production for export shall also be sent to the Agency and to the Council. [ 4. Packing and marking. :- The materials manufactured by exercising quality control measures as percontrol referred to under rule 3 shall be packed as per the requirements, if any, laid down in the standard specifications and marked with the following information: - (a) Name of manufacturer and / or registered trade mark, if any (b) Bale / roll number (c) Gross weight (d) Net weight (e) Name of the material (f) Quantity (g) Any other information required by the law in force in India and the importing country. 5. Affixation of stamp. :- 1 [Every bale / roll of the matenal packed and marked in accordance with the rule 4 shall be stamped by the manufacturing mill with the stamp approved for the purpose by the Council ] 1. Procedure for inspection. :- 1 (1) The exporter / mill intending to export jute products shall give intimation in writing of his intention so to do and submit alongwith such intimation a declaration of the specifications stipulated in the contract relating to such export to the nearest office of the Agency He shall also submit alongwith such intimation a declaration that the consignment of jute products has been manufactured by exercising quality control measures as per control referred to under rule 3 and that the consignment conform to the requirements of the specifications recognised for the purpose (2) The exporter / mill shall also furnish to the nearest office of the Agency the identification marks applied on each bale /roll of the consignment (3) Every intimation and declaration under sub-rule (1) shall reach the nearest office of the Agency not less than 3 days prior to the despatch of the consignment from the manufacturer's premises (4) On receipt of intimation and declaration under sub-rule (1), the Agency, on satisfying itself that the jute products have been manufactured as per requirements of rule 3 and the instructions, if any, issued by the Export Inspection Council in this regard have been observed, shall issue a certificate declaring the consignment as export-worthy 1. Place of inspection. :- 1 Inspection of jute products for the purpose of these rules shall be carried out be carried out at the premises of the mills ] 1. Inspection fee. :- 1 - Fees at the following rates shall be paid as inspection fees for inspection of jute products - (i) Carpet Backing Rs. 9 55 per metric ton (ii) Hessian Cloth / Bag Rs 1275 per metric ton (iii) Sacking Cloth / Bag others Rs 8 45 per metric ton ] 1. Consignment-wise inspection. :- 1 - If at any time, the manufacturing mill fails to implement inprocess quality control in accordance with the provisions of rules 3 to 5 above due to any leason, pre-shipment inspection shall be carried out on a consignment-wise basis in accordance with instructions issued by the Council in this regard and the inspection fee for such inspection would be charged at double the rates specified under rule 9 ] 1. Appeal. :- 1 (1) Any person aggrieved by the refusal of the Agency to issue a certificate under rule 6(4) and rule 10, may within ten days of the receipt of the communication of such refusal, prefer an appeal to a panel of experts consisting of not less than three persons, as may be constituted for the purpose by the Central Government (2) The quorum of the panel shall be three (3) The decision of the panel on such appeal shall be final ] 1.
