EXPORT OF LAMINATED JUTE PRODUCTS (INSPECTION) RULES, 1975 S.O. 4068, dated 20th September, 1975.1 -In exercise of the powers conferred by Sec 17 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), the Central Government hereby makes the following rules, namely - 1. Short title and commencement :- (1) These rules may be called the Export of Laminated Jute Products (Inspection) Rules, 1975 (2) They shall come into force on the date of their publication in the Official Gazette 2. Definitions. :- In these rules, unless the context otherwise requires - (a) "Act" means the Export (Quality Control and Inspection) Act, 1963 (22 of 1963), (b) "Agency" means any of the Export Inspection Agencies established at Bombay, Calcutta, Cochin, Delhi and Madras under Sec 7 of the Act, (c) Laminated Jute products shall mean and include the following, namely - (i) Jute cloths or bags laminated with polyethylene or paper using adhesive (ii) Jute cloths or bags coated directly (extrusion coated) with polyethylene (iii) Jute bags with loose liner of polyethylene or paper (iv) Any other type of laminated jute products 3. Basis of inspection. :- Inspection of laminated jute products intended for export shall be carried out with a view to seeing that the laminated jute products conform to the specifications recognised by the Central Government under Sec 6 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963) (hereinafter referred to as the recognised specifications) 4. Procedure of inspection. :- (1) An exporter intending to export laminated jute products shall give an intimation in writing of his intention so to do to the nearest office of the Agency (2) Every intimation for this purpose shall reach the office of the Agency not less than seven days before the expected date of shipment (3) Before giving the intimation referred to in sub-rule (1) the exporter shall himself inspect the goods carefully and remove all such goods which do not conform to the recognised specifications (4) The goods shall be packed and kept ready in well lighted place (5) The exporter shall provide the necessary facilities to the inspection officer of the Agency for carrying out inspection to ensure that the consignment conforms to the recognised specifications (6) On receipt of the intimation referred to in sub-rule 2, the Agency shall inspect the consignment of laminated Jute products in accordance with the instruction issued by the Council in this behalf from time to time, with a view to seeing that the same complies with the requirement of the recognised specifications 5. Place of inspection. :- T h e inspection shall be carried out at the premises of the manufacturer or at the premises of the exporter 6. Inspection fee. :- Subject to a minimum of Rs. 30 for each consignment, a fee at the rate of 0.50 percent, of the F.O.B. value of each consignment shall be paid as inspection fee for inspection of laminated jute products. 7. Certificate of inspection. :- After satisfying itself that the consignment of laminated jute products conform to the specifications recognised by the Central Government under Sec. 6 of the Act, the Agency shall within seven days of the receipt of the intimation and the particulars of the consignment under sub-rule (1) of rule 4, issue a certificate to the exporter declaring that the consignment conforms to the recognised specifications and is export-worthy : Provided that where the Agency is not so satisfied it shall within the said period of seven days refuse to issue such certificate and communicates such refusal to the exporter alongwith reasons therefor. 8. Appeal. :- (1) Any person aggrieved by the refusal of the Agency to issue a certificate under rule 7 may within ten days of receipt of communication of such refusal by him prefer an appeal to a panel of not less than three but not more than seven such experts as may be appointed for the purpose by the Central Government. (2) At least two-thirds of the total membership of the panel of experts shall consist of non-officials. (3) The quorum for the panel shall be three. (4) The appeal shall be disposed of within fifteen days.
