Special conditions for grant of certificate of authorisation Garlic Grading and Marking Rules, 2002 Whereas the draft of Garlic Grading and Marking Rules, 2001 were published, as required by Sec. 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) under the notification of the Government of India in the Ministry of Agriculture number G.S.R. 560 dated the 21st September, 2001 appearing on page No.3219-3234 of the Gazette of India, Part-II, Sec. 3, sub-sec. (i) dated, the 6th October, 2001, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of forty five days from the date on which the copies of the Gazette containing the said notification are made available to the public; And whereas copies of the said Gazette were made available to the public on 23rd October, 2001; And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by Sec. 3 of the Agricultural Produce (Grading and Marking) Act, 1937 and in supersession of the Garlic Grading and Marking Rules, 1964, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following Rules, namely : 1. Short title, application and commencement :- (1) These rules may be called the Garlic Grading and Marking Rules, 2002. (2) They shall apply to Garlic (Allium Sativum L.) Dehydrated Garlic and powder. (3) They shall come into force on the date of their final publication in the Official Gazette. 2. Definitions :- In these rules (i) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (ii) "Authorised packer" means a person or a body of persons who has been granted the certificate of authorisation to grade and mark the commodity in accordance with the grade standards and procedure prescribed under these rules; (iii) "Certificate of Authorisation" means the certificate issued under the provisions of General Grading and Marking Rules, 1988, authorising a person or a body of persons to grade and mark the commodity with the grade designation mark; (iv) "Schedule" means schedule appended to these rules; (v) "Damage" in relation to Garlic means any injury or defect which materially affects the appearance or the shipping quality of the individual bulb of the lot and includes one or more of the following namely : (a) dirt or stain, that is to say, anything which affects the appearance to an extant greater than 15 per cent of the bulbs in a lot as clarified under foot-note of each Schedule from II to V; (b) sprouting, that is to say, development of visible sprouts on the bulbr, (c) sun-burn, that is to say, discolouration due to exposure to the sun when there is no injury to the tissue; (d) sunscald, that is to say, softening of the tissue due to exposure to the sun; (e) tops, that is to say, lengths of the tops of garlic not trimmed to less than 5.0 cms; (f) "diameter" in relation to garlic means the gratest dimension of the garlic bulb taken at right angles to the straight line running from the stem to the root end; (vi) "dehydrated garlic" means the garlic from which bulk of the moisture has been removed by dehydration under controlled conditions; (a) "Garlic flakes" means the product obtained by slicing or mincing garlic and sieving after dehydration to remove grits and powder. (vii) "Garlic Powder" means the powder obtained by grinding dehydrated garlic to obtain a free-flowing powder of which not more than 2% shall be retained on 500 micron's sieve. 3. Grade designations :- The grade designations to indicate the quality of garlic shall be as set out in column (1) of Schedules from II to VII. 4. Definition of quality :- The quality indicated by the grade designations shall be as set out against each grade designation in Schedules II to VII. 5. Grade designation mark :- The grade designation mark shall consist of "AGMARK INSIGHIA" consisting of the design incorporating the certificate of authorisation number, the word "AGMARK", name of the commodity and grade designation resembling the one as set out in Schedule-I. 6. Method of marking :- (i) The grade designation mark shall be securely affixed to or clearly and indelibly printed on each container; (ii) In addition to the grade designation mark and name of the commodity, the following particulars shall be clearly and indelibly marked on each container : (a) Name and address of the packer; (b) Name and address of manufacturing unit; (c) Date of packing; (d) Best before............month and..... year, (e) Net weight; (f) Lot/Batch No.; (g) Price; (iii) An authorised packer may, after obtaining prior approval of the Agricultural Marketing Adviser or any officer authorised by him in this behalf, in accordance with Rule 11 of the General Grading and Marking Rules, 1988, affix his private trade mark or trade brand on graded packages/containers provided that the same does not indicate quality or grade other than that indicated by the grade designation mark affixed to the graded packages/containers in accordance with these rules. 7. Method of Packing :- ( i) Graded garlic shall be packed only in sound, clean and dry containers made of jute, wooden crates, netting bamboo baskets, palm-leaf baskets including consumer packs of the same material. (ii) The dehydrated garlic and powder shall be packed in clean, sound containers made of material which does not affect the garlic and powder and protects it from the uptake of moisture. The consumer packs of size 50 to 1000 gms may be packed in pouches made from paper/0.02 mm aluminium foil/150 gauge polyethylene laminates. The pouch may be closed tightly in a 2 ply corrugated sheet cover/carton or any other material as may be required by the buyer and/or approved by the Agricultural Marketing Adviser or any officer authorised by him in this behalf and the packing material is made of food grade quality as permitted under Prevention of Food Adulteration Rules, 1955; (iii) The container shall be securely closed and sealed in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf. They shall be free from any insect infestation or fungus contamination and also from any undesirable or obnoxious smell; (iv) Each package shall contain garlic, dehydrated garlic and powder of one grade designation only. Suitable number or small packets of dehydrated garlic/powder containing a graded material of the same lot. batch and grade designation may be packed in a master container such as jute bages, wooden cases, cardboard cartons etc. with details on master containers. 8. Special conditions for grant of certificate of authorisation :- (i) In addition to the conditions specified in sub-Rule (8) of rule 3 of the General Grading and Marking Rules, 1988, the following shall be the conditions of every Certificate of Authorisation issued for the purpose of these rules, namely; (ii) The authorised packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with Rule 9 of the General Grading and Marking Rules, 1988 for testing the quality of garlic, dehydrated garlic and powder or have access to the State Grading Laboratory or Private Commercial Laboratory approved for the purpose; (iii) The premises for processing, grading and packing shall be maintained in perfect hygienic and sanitary conditions; (iv) The personnels engaged in this operation shall be in sound health and free from any contagious disease.
