Repeal and Savings SCHEDULE 1 :- SCHEDULE GUJARAT PANCHAYAT SERIVCE (Conditions of Service) RULES, 1977 No. KP/63/(77)/PRR-1076-2888-TH.-In exercise of the powers conferred by section 323 read with section 203 of the Gujarat Panchayats Act, 1961 (Guj. VI of 1962), the Government of Gujarat hereby makes the folloing rules, namely: 1. Short title :- (1) These rules may be called the Gujarat Panchayat Service (Conditions of Service) Rules, 1977. (2) They shall come into force with effect from the date of their publication in the Official Gazette. 2. Definitions :- In these rules, unless the context otherwise requires: (a) "the Act" means the Gujarat Panchayats Act, 1961; 1[(b) "District Cadre", 'Taluka Cadre' and 'Local Cadre' means respectively the District Cadre, Taluka Cadre and Local Cadre as constituted by Government Order Panchayats Housing and Urban Development Department No. KP/40/70/PRR-J075/1668/TH, dated the 30th March, 1977]. (c) "Government" means the Government of the State of Gujarat : 1[(d) "Panchayat" means a District Panchayat, Taluka Panchayat or as the case may be, a Gram Panchayat or a Nagar Panchayat]. (e) "Panchayat Service" means the Panchayat Service as constituted under section 208; 1 [(f) "Panchayat Servant" means any person who belongs to the Superior Panchayat Service or as the case may be. Inferior Panchayat Service]. (g) "Section" means a section of the Act; (h) "Superior Panchayat Service" and "Inferior Panchayat Service" means respectively the Superior Panchayat Service and the Inferior Panchayat Service as constituted respectively by clause (a) and clause (d) of subrule (2) of rule 3 of the Gujarat Panchayat Service (Classification and Recruitment) Rules, 1967. 1. Application of Bombay Civil Services Rules, 1959 to panchayat servants :- The Bombay Civil Service Rules, 1959, (except the Revised Pension Rules, 1950 and the rules relating to pension, gratuity and other retire- meat benefits elsewhere continued therein) (here-in-after referred to as 'the Civil Service Rules") as in force at the commencement of these rules shall, as amended by Government from time to time, apply to the Panchayat Servants subject to the modifications specified in rule 4. 4. Modifications :- (1) The authority in the Civil Services Rules vested in the Government ofGujarat or any authority subordinate to the Government shall, in regard to the panchayat servants, be considered to vest in the District Panchayat. (2) In the Civil Service Rules, unless the context otherwise requires. (i) for the words "Government servant" whenever they occur, the words "panchayat servant" shall be substituted; (ii) for the words "Government service" wherever they occur, the words "Panchayat Service" shall be substituted; (iii) for the words "in the service of Government" wherever they occur, the words "in the service of panchayat" shall be substituted; (iv) for the words "Consolidated fund of the State" wherever they occur, the words "Taluka Fund" or, as the case may be, "District" fund shall be substituted; and (v) for the words "Head of Departments" whenever they occur the words "District Development Officer" shall be substituted; 5. Repeal and Savings :- Any rules corresponding to the Civil Services Rules in force before the commencement of these rules and applicable to the panchayat servants are hereby repealed, Provided that such repeal shall not:- (a) affect the previous operation of the rules so repealed or anything duly done or suffered thereunder, or (b) affect any right, privilege, obligation or liability acquired, accused or incurred thereunder; or (c) affect any penalty, forfeiture of punishment incurred thereunder; or (d) affect any investigation, legal proceedings or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid and any such investigation, legal proceeding or remedy may be instituted, constituted or enforced and any such penalty, forfeiture or punishment may be imposed under the corresponding provisions of the Civil Service Rules and where there are no corresponding provisions under the Civil-Service Rules, such investigation, legal proceeding or remedy may be instituted, continued or enforced in accordance, with the rules so repealed and the penalty, forfeiture or punishment may be imposed thereunder, as if the rules were not repealed: Provided further that anything done or any action taken under any of the rules so repealed shall be deemed to have been done or taken under the corresponding provisions of the Civil Service Rules. -Order u/s 203(2), dt. 30-3-1977. Panchayats and Health Department No. KP/873/PRD/39/67-Th, dated the 2nd January, 1967 the Government of Gujarat hereby directs:- 1 ["(1) that the Panchayat Service shall consist of District Cadre, Taluka Cadre and Local Cadre. (2) that the posts specified in Part I of the Schedule appended here to shall belong to a District Cadre. (3) that the posts specified in Part II of the said Schedule shall belong to a Taluka Cadre, and (4) that the posts specified in Part III of the said Schedule shall belong to a Local Cadre.] 1.
