Holding colloquial test SCHEDULE 1 :- SCHEDULE GUJARAT PANCHAYAT SERVICE (Gujarati Language Examination) Rules, 1964 No. KP/l 18/PRK-46/64-JH-In exercise of the powers conferred by section 323 of the Gujarat Panchayats Act, 1961 (Guj. VI of 1962) the Government of Gujarat hereby make the following rules, namely:- 1. Short title and extend :- (1) These rules may be called the Gujarat Panchayat Service (Gujarati Language Examination) Rules, 1964. (2) They shall apply to all -persons recruited to the Panchayat Service. 2. Definitions :- In these Rules, unless the context otherwise requires:- (i) "the Act' 'means the Gujarat Panchayats Act, 1961. (ii) "Board" means the Gujarat Panchayat Service Selection Board constituted under section 210 of the Act, (iii) 'Government" means the Government of the State of Gujarat; (iv). "Inferior servant" means a member of the panchayat service holding any of the posts specified in the schedule appended to these rules; (v) "Panchayat Service" means the panchayat service as constituted under section 203 of the Act. 3. Categories of persons required to pass the examination :- (1) Every person in the Panchayat Service, to whom these rules apply, shall be required to pass- (a) an examination in Gujarati Language, if he is person other than an inferior servant, and (b) a colloquial test in Gujarati Language, if he is an inferior servant as hereinafter prescribed[witbin aperiod of two years from the date of joining his first appointment in the panchayat at service [or before 31st December, 1980] whichever is later] : Provided that in the case of persons allocated to the panchayat service or recruited to the panchayats service before the commencement of these rules, the said period of two years shall be counted from the date of the commencement of these rules : Provided further that the District Development Officer may, in deserving cases, extend the said period of two years by one year. (2) Nothing in sub-rule (1) shall apply to a member of the panchayat service: (a) whose mother tongue is Gujarati; or (b) who has prior to his appointment to the Panchayat Service acquired the required knowledge of Gujarati by virtue of his having passed (c) who has already passed the regional language test in Gujarati prescribed by Government, or (d) who has been exempted from passing the examination or the colloquial test, as the case may be, under these rules. (3) Notwithstanding anything contained in sub-rule (1) above, Government or an officer authorised by it in this behalf may declare certain categories of posts in the Panchayat Service to which the provisions of clause (b), instead of the provisions of clause (a), of the said sub-rule (1) shall apply on the ground that they are either technical posts or posts akin to those held by inferior servants where only limited knowledge of Gujarati language is considered to be sufficient. 4. Power of District Development Officer to grant exemption :- Notwithstanding anything contained in these rules, a District Development Officer may grant exemption from the operation of these rules to any member of the panchayat service who satisfies the District Development Officer that on account of his domicile in the State of Gujarat for not less than (ten) years, he has acquired the required standard of knowledge of Gujarati language which would enable him to efficiently discharges the duties of the post held by him in the Panchayat Service. 5. Penalty for failure to pass examination :- Subject to the provisions of the forgoing rules, the passing of the Gujarati language examination or colloquial test, as the case may be, shall be compulsory. Failure to pass the examination test within the prescribed period, or in cases in which the period has been extended during such extended period, shall result in withholding of increments with effect from the date of expiry of the said period: Provided that increments so with held shall stand released with effect from the date on which the said person passes the examination/test or is exempted from passing the examination/test, and all the future-increments shall accure as if no increments were withheld. Explanation- For the purposes of this rule, the date of passing the examination or colloquial test shall be the date following the date on which the examination or as the case may be, the test held had ended. 6. Syllabus, standard and qualifying marks for the examination :- (1) The syllabus, standard and qualifying marks for the examination shall be as under: - \ \ \Subjects (i) (a) Essay writing or letter writing in Gujarati, and (b) Precise or summary of a given passage in \ Gujarati 100 marks. (ii) Questions set from the prescribed text books 100 marks. (iii) Viva-voce test comprising manuscript reading \ and conversation. 100 marks. \ \ \ \ \ \ \ \ \ \------------ \ \ \ \ \ \ \ \ \ \ 300 marks. \ \ \ \ \ \ \ \ \ \------------ TEXT BOOKS (i) Gandhijini Sankshipta Atma Katha, epitomised by Mathurdas Trikamji and published by Navjivan Prakashan Mandir. (ii) Otarati Diwalo By Kaka Kalelkar. The text books may be changed from time to time by order and at the discretion of Government. (2) In order to pass an examination, a candidate shall have to secure 45% marks in individual subjects and 50% marks in the aggregate, and in the case of colloquial test, he shall have to secure 50% of the total marks to pass the test. (3) A candidate securing not less than 60% marks in an individual subject shall be exempted from appearing in that subject again, (4) A candidate who appeals in all the subjects at one and the same time but fails to obtain the required minimum marks in one subject alone, shall be entitled to have deficiency under that subject condoned, provided the deficiency does not exceed 5 marks in that subject, and in the case of a candidate who appears in all subjects at one and the same time and passes in them individually but fails to secure 50% of the total number of marks for the test, the deficiency in the total number of marks shall be condoned if it does not exceed 10 marks. 7. Holding of examination, arrangement :- The Gujarati language examination shall be held by the Board 1 [once] a year by giving at least two months notice in advance in respect of each examination. The arrangements for setting of the question paper, for supplying the same to the District Development Officer according to their needs, for appointment of examiners and for declaration of result shall be made by the Board. 1. Holding colloquial test :- The Gujarati language colloquial test shall be held by the District Development Officers of the respective district panchayats 1 [once] a year by giving at least two months notice in advance in respect of each test.
