GUJARAT PANCHAYAT SERVICE (Hindi Examination) RULES, 1965 NO.KP/510/PRR.59/65.JH.-In exercise of powers conferred by section 323 of the Gujarat Panchayats Act, 1961 (Guj. VI of 1962), the Government of Gujarat hereby makes the following rules, namely:- 1. Short title :- These rules may be called the Gujarat Panchayat Service (Hindi Examination) Rules, 1965. 2. Definitions :- In these rules, unless the context otherwise requires:- (i) "the Act" mean? the Gujarat Panchayats Act, 1961; (ii) "Board" means the Gujarat Panchayat Service Selection Board established under section 210 of the Act; (iii) "Government" means the Government of the State of Gujarat; (iv) "inferior servant" means a servant in the Panchayat Service holding any of the posts specified in the Schedule "C"; (v) "Panchayat Service" means the Panchayat Service as constituted under section 203 of the Act; (vi) "Schedule" means a Schedule appended to these rules. 3. Conduct of Examinations :- (1) The examinations prescribed under these rules shall be conducted by the Board on such dates, at such places, and through such authorities and agencies as it may, from time to time, determine: 1["Provided that every such examination shall be held once a year by giving as far as possible two months' notice in advance in respect thereof"] (2) The arrangements for setting of the question papers, for their supply to the candidates at the examinations, for appointment of examiners, and for declaration of results shall be made by the Board. 2 [(3) Arrangements for conducting the examination at the places determined by the Board under sub-rule (1) shall be made by the chief conductors examination appointed by the Board for such places. 1. Examinations and categories of persons required to pass them :- 1.- (1) Subject to the provisions of rule 6, every person in the Pahchayat Service shall be required to pass:- (a) Higher Standard Examination if he is a person holding any of the post specified in Schedule 'A'; (b) Lower Standard Examination if he is a person holding any of the post specified in Schedule 'B'; and (c) Colloquial Standard Examination if he is a person holding any of the posts specified in Schedule "C" as hereinafter prescribed, within a period of three years from the date of his appointment on the post concerned either by allocation or recruitment, and in cases of promotion within a period of two years from the date of promotion: Provided that the State Government may by notification in the Official Gazette, extend the said period of three years as the case may be, the said period of two years by a period not exceeding one year. (2) Notwithstanding anything contained in sub rule (1)- (i) every person in the Panchayat Service who was required to pass the examination within, the, period specified in the said sub-rule (1) but could not pass the examination within the said period shall be required to pass the examination before 2 [31st December, 1983] (ii) if in the case of any person in the panchayat service . the State Government is satisfied that he could not pass the examination at which he had his last chance, for persons beyond his control or that he failed to pass such examination by a very narrow margin of marks, the Stale Government may, after recording reasons in writing, give to such person one more chance to pass the examination. (3) If a candidate who is required to pass Lower Standard Examination passes Higher Standard Examination or a candidate who is required to pass Colloquial Standard Examination passes Lower Standard Examination or Higher Standard Examination he shall be deemed to have complied with he provision of this rule. 1. Penalty for failure to pass examination :- (1) If a person who is required to pass any examination, 1under these rules fails to pass it within the period prescribed in rule 4, or in cases in which such period has been extended, within such extended period, his increments in pay shall be liable to be withheld with effect from the date of expiry of such period: Provided that the increments so withheld shall be released with effect from the date on which the person concerned passes the requisite examination, and all the future increments shall accure to him as if no increments had been withheld, 2 [xxx]. 2. If an inferior servant who is required to pass the Colloquial Standard Examination, fails to pass such examination within the period specified for the purpose in or under the rule 4, he shall not be eligible for promotion until he passes such examination. He shall, however, be eligible for such promotion on his passing such examination, and by reverting if necessary, his junior who might, have been promoted during the intervening period. 1. Exemption from passing the Examination :- 1.- (1) The following categories of persons in the Panchayat Service shall be exempted from passing the Examination under these rules to the extent, if any specified below:- 2["(i) Persons who have passed any of the examinations mentioned in sub-clause (a), (b), (c), (d) or (e)]; (a) the''Kovid" "Parichayat" and "Pravesh" Examinations of Rashtra Bhasha Prachar Samiti, Vardha: (b) the 'Quabil",Tisari" and "Dusri" Examinations of the Hindustani Prachar Sabha, Wardha and Bombay; (c) The "Vinit", "Tisari" and "Dusri" Examination of the Gujarat Vidyapeeth, Ahmedabad; (ii) Persons who have passed the Hindi Tisari and Dusri Examinations conducted by the Saurashtra Rachanatmak Samiti, Rajkot before 31st March, 1957 shall be exempt from passing the Lower and Colloquial Standard examinations respectively. (ii) All officers servants who were in the employment of former District Local Boards and who have passed before the 24th December. 1965 being the date on which these rules came into force the obligatory Hindi Examination of any of the private institutions recognized by the former Government according to rules applicable to them. (iv) (a) All persons appointed to public services and posts in connecwith affairs of the former State Madhya Pradesh Hyderabad and Kutch, who have already passed an examination in Hindi under the rules if any, prescribed by the concerned Government of the State or an examination of the private institution, if any, other than those mentioned in sub-rule (i) above which has been recognised before 1st November, 1956 by ths Goverment as equivalent to prescribed examination; (b) All persons aypointed to public service and posts in connection with affairs of the former States of Madhaya Pradesh and Baroda who have passed the departmental examination including paper in Hindi; All persons appointed to public service and posts in connection with affairs of former State of Saurashtra who have passed the -Shalant examination or its equivalent examination shall be exempted from passing the Colloquial examination. (v) Persons who have passed prior to 1957 the SSC Examination prescribed under the Bombay Secondary School Certificate Examination Act, 1 948 with Hindi as additional subject according t o course shall b3 exempt from passing Lower Standard Examination. (vi) Persons who have completed 45 years of age on 3[31st December, 1983] i.e. persons who were born or before the i[31st December 1938] (vii) Persons holding any of the post specified in Schedule 'D'. (viii) Persons who having their mother tongue as Hindi have passed the matriculation examination or its equivalent examination with Hindi as one of the subject of any statutory body shall be exempted from passing the Higher Standard Examination. (ix) Persons whose mother tongue as Hindi shall be exempt from passing the Colloquial Standard examination. (x) Persons who have passed an examination in Hindi prescribed by the Central Government or by any other State Government : Provided that the standard of the examination passed by them is considered equivalent to the standard of the examination which they are required to pass under these rules. (xi) Persons who have passed the obligatory Hindi Examination of the Ad-hoc Hindi Examination Board, appointed by Government or by the Director of Languages, which he was required to pass before allocation to Panchayat Service. 4[(xii) Panchayat employees or officer who have passed the examination of Hindi subject in Secondary School Certificate Examination or in its equivalent examination of statutory body or in any higher examination shall be exempted from the requirement of passing the Coloquial Standard, Lower Standard or Higher Standard Examination in Hindi, as the case may be] (xiii) 5[xxx] (xiv) 5[xxx] (xv) Persons who are blind. (xvi) Pensons who are dumb shall be exempt from passing the Colloquial Standard Examination. (xvi) Inferior servants, with reference to whose duties knowledge of Hindi Language is considered not necessary by the District Development Officer shall be exempted from passing the Colloquial Standard Examination. (xviii) Persons who are required to pass the lower standard examination in Hindi as per rule and who are eligible to get exemption from passing the Higher Standard Examination in Hindi shall not be required to pass the Lower Standard Examination in H indi, and those who are requirred to pass the colloquial examination in Hindi and who are eligible to get the exemption from passing the lower standard examination shall also be exempt from passing the colloquial examination in Hindi. 7 [(xix) Persons who have passed the Hindi Dusri or Tisri Examination of the Saurashtra Hindi Parchar Samiti, Rajkot shall be exempted from the requirement of passing the colloquial or lower Standard Examitution in Hindi respectively] (2) The question whether a person is exempted under sub-rule (1) shall be decided by the concerned District Development Officer." 1. Syllabus :- Standard and Qualifying Marks for the Examination.- (1) The syllabus, standard and qualifying marks for the examinations shall be as under :- 1[(A) SYLLABUS: \(i) Higher Standard Examination : \This will consist of three papers and oral test. \(a) Written Examination \ Marks Duration \Paper: I Prescribed Text Books 100 3 hours. \Paper : II Prescribed Text Books 100 3 hours. \Paper : III Essay writing, Grammer, Precis writing, \ \ letter writing, noting and drafting and \ \ translation into Hindi form Gujarati or \ \ English. 100 3 hours. Hindi Balpothi" Author-Giriraj Kishor Published by Gujarat Vidyapeeth, Ahmedabad.] 2 [ (C) Standard for passing the examination : (i) Higher Standard Examination-The minimum number of marks required for passsing in each written question paper shall be 35 per cent, in oral 40 percent and in all aggregate 40 per cent. (ii) Lower Standard Examination-The minimum number of marks required for passing in each written question paper and oral shall be 35 per cent and all aggregate 40 per cent. (iii) Colloquial Standard Examination-The minimum number of marks required for passing in direction shall be 10, and in oral test shall be 20, and in all 40 per cent respectively. The minimum number of marks required to be obtained for those candidates who are appearing only in oral test shall be 24 out of 60 marks.] (D) Merit Certificate.-The persons passing the Examination in the standard prescribed for them with 75 percent marks or more marks shall be awarded a merit certificate in the prescribed form. (E) Exemption:-A candidate to be eligible to claim exemption from appearing for ony paper of the Higher and Lower Standard Examination at a subsequent examination, shall have obtained a minimum 50 percent of marks. A candidate who has been exempted shall be required to state specifically whether he wishes to avail of such exemption while appearing at the subsequent examination. He shall not be entitled to avail of previous exemption if he decides to appear at the entire examination : Provided that no exemption shall be allowed in respect of colloquial examination. 1. Application for permission to appear at the Examination :- (1) In order to appear at any of the examinations specified in these rules, a candidate shall have to apply in such form as may be laid down by the Board from time to time the Chief Conductor of Examination through the Head of office in which he is working so as to reach the Chief Conductor before such date as may be fixed by him. (2) (a) A candidate who subsequent to acceptance of his application for appearing the Hindi Examination, is transferred or sent on duty to a place in another district or is absent from his headquarters on leave or vacation. may within such period as is fixed in this behalf by the Chief Conductor, apply to the Chief Conductor for change of place of the examination, where he has to appear. (b) On receipt of an application under clause (a), the Chief Conduc to shall transfer the same with his remarks thereon to the Chief Conductor of the place of examination where the candidate intends to appear; (c) If the application is granted, both the Chief Conductors shall make necessary charges in their records. 9. . :- 1 [x x x] 1. Supply of Marks to candidates who fail in the Examination :- Marks obtained by candidate who have failed in an examination shall be commmunicated to the Chief Conductor concerned by the Board; for information to the candidates. 11. Verification of Marks obtained by candidates in papers :- (1) Alter the declaration of the result of the examination, candidates may apply to the Board, for verification whether their answers in any particular paper have been examined or whether there has been a mistake in totalling of marks in the papers. Papers o f candidates who have failed shall not be reexamined in any circumstances, but verification of marks obtained by such candidates may, be made. (2) A candidate who desirs to get marks verified shall submit application giving particulars relating to his name, seat number, standard and place of examination etc. within eight weeks from the date of declaration of the result of the examination. No application received after the aforesaid period shall be entertained. 12. . :- Notwithstanding anything contained in any other rules relating to travelling allowance, the travelling allowance for journeys to attend the examination required to be passed by a person under these rules shall be allowed;- (a) in respect of the journeys undertaken for attending that examintion at which he is declared successful; (b) in respect of the journey undertaken for attending that examination at which he is declared unsuccessful: Provided that nothing contained in clause (b) shall entitle a person to travelling allowance in respect of journey for more than two examinations at which he is declared unsuccessful: Provided further that travelling allowance under clause (b) shall be allowed only if the candidate has secured not less than twenty five percent of the total marks".
