Section :- These rules may be called the Gujarat State Lottery Rules, 1981 (hereinafter referred to as "The Rules"). 2. Section :- These rules shall come into force at once. 3. Section :- (1) The Gujarat State Lottery Schemes shall be administered by the Director of State Lotteries (hereinafter referred to as "the Director"). He shall be under the overall control of the Government of Gujarat, Finance Department (hereinafter referred to as "the Government"). He shall be assisted by other officials appointed by Government from time to time. (2) The Government may constitute a Lottery Advisory Committee and may refer various policy matters pertaining to State Lottery Schemes for the advice of this Committee from time to time. 4. Section :- (1) The lottery scheme shall be implemented by the Director. The Collector of a district shall be in overall charge of the working of the lottery scheme in his district and shall exercise the powers vested in him under these Rules or as may be delegated to him in this regard. (2) Government may appoint officers in the districts to assist, the District Collectors and the Director, in the implementation of the lottery scheme. 5. Section :- (1) The number and value of prizes for any draw shall be such as may be notified by the Government in the Official Gazette in this behalf and to which wide publicity shall be given 1 [(2) Prizes for the series will be drawn for each series of tickets separately.) 1. Section :- Tickets for the State Lottery shall be issued in the denominations as may be decided by the Government from time to time. 8. Section :- (1) Tickets in books shall be issued in distinct and separate series and each series shall be distinguished by a distinct alphabetical notation. (2) The number of tickets in each series will be consecutive from 000000 onwards. The number of tickets in each series shall not be more than 10.00,000 unless otherwise decided by the Government. 9. Section :- The Government shall decide the number of series to be released for sale for each draw and the number of each series. 10. Section :- The tickets intended for each draw shall bear the facsimile signature of the Secretary to Government of Gujarat, Finance Department and the date of draw. The Government shall have the right to postpone the date of draw, without assigning any reasons. 11. Section :- (1) The lottery tickets shall normally be made available to the public through authorised Agents to be appointed for this purpose. The Government or Director may, however, make arrangements for sale of tickets directly to the public. (2) The Government or Director may also offer tickets directly to any person (which expression shall be deemed to include a body of persons) for sale. (3) The Director of State Lotteries shall be competent to issue tickets to wholesale Agents for whole of the State or part of it or to casual Agents, under special circumstances. 12. Section :- (1) Sale of tickets to the Agents shall be at the various Sub- Treasuries/District Treasuries in the State. (2) The sale of tickets to Agents in respect of each draw shall stop three to four days before the date of draw (including the date of draw) or on such dates as the Director may decide from time to time. The Government reserves the right to alter the above arrangement without notice to such an extent as may be considered necessary. 13. Section :- The appointment of Agents shall be made by the District Collectors within that district. In respect of States and areas outside Gujarat. the Director shall appoint the Agents. Application for appointment as Agents should be made in Form GSL 1. 1 The Director may also appoint Stickiest for sale/distribution of lottery tickets to the public. The area jurisdiction and other terms and conditions of the Stockiest will be as decided by Government from time to time. Section :- Every person selected for appointment as Agent will be issued a certificate of appointment to act as an Agent in Form GSL-3 after the said person has executed an agreement in Form GSL-2 with the Director or with the District Collector concerned, provided the said person has deposited an amount as prescribed below by way of security deposit and produced a receipted challan in proof of having paid the said security deposit. The amount of security deposit should be paid by challan either in the State Bank of India or State Bank of Saurashtra transacting Government cash business at the District or Taluka headquarters and at other places. Where the banking facility is not available, the security deposit should be paid with challan in the nearest non-banking Sub-Treasury in the District. In all cases, the challan should first be prescribed at the Treasury/Sub-Treasury as the case may be for enactment before it is presented at the Bank's counter. Place where application is made The security deposit shall be refunded on termination of the agency. No special orders of Government shall be required for refund of security deposit. The stamp duty on the agreement referred to above and its duplicate shall be borne by Government. 15. Section :- (1) It shall be incumbent upon every Agent to make the minimum purchases of lottery tickets as prescribed below for each draw either in one lot or in instalhnents not exceeding the number mentioned below from the Treasuries, Sub-Treasuries, where the security deposit is paid within the entire period during which the sale of tickets for the relevant draw is on at the issuing office concerned:- 1 [(1-A) It s hall be incumbent upon every agent to make half minimum purchase of lottery tickets as specified in sub-rule (1) each weekly draw.] (2) If an Agent fails to make the minimum purchase of tickets, the. agency shall normally be liable to be terminated and the security deposit of the Agent concerned shall be liable to be forfeited to Government in part or in full. However, the termination of agencies and forfeiture of deposits in such cases shall be ordered by the Director or the Collectors of Districts as the case may be, on merits. 1. Section :- (1) It shall be open to the Government to terminate the appointment of any Agent for good and sufficient reasons. It shall also be open to the Government to forfeit the security deposit of any Agent if irregularities are noticed in the discharge of functions of such Agents. The decision of the Government in this respect shall be final and binding. (2) The Director of the Lotteries and the Collector of districts shall exercise the powers of Government in this regard to the extent these powers are delegated to them by Government from time to time. 17. Section :- The Agent appointed under the State Lottery Scheme shall be eligible for a commission of fifteen per cent of the value of the tickets purchased by him. 18. Section :- The Agent 1[and the stockiests] shall purchase tickets in books on payment of full value of tickets less commission allowable on the face value of the tickets. The Commission will be allowed at source. It will, therefore suffice if the Agent deducts the amount of commission while purchasing the lottery tickets and pays only the net amount by challan in the Bank/Treasury as the case may be and produce the original receipted challan before the issuing office as a proof of payment. Payment may also be made by Agents by crossed demand drafts 2[and bank pay-order] issued by any Scheduled Bank. 3[Tickets may also be made available at the District Treasuries 4[and specified Sub-treasuries] to agents against cash payment upto the amount as may be specified by Government from time to time and notified separately by Government]. The Agents should, at the time of every purchase, pass a receipt 5 [in form GSL-6] (stamped if the amount exceeds Rs. 20/-) for the amount of commission in favour of the ticket issuing officer. 1. Section :- (1) The lottery Agents 1[and stockiest] who happen to purchase lottery tickets from the issuing offices the lottery tickets which win a by of the prizes of the values mentioned below shall become entitled to get bonus at the following rates: (i) Prizes of Rs. 1,000 and above.................5% of the value of the prize. (ii) Prizes less than Rs. 1,000....................Nil. (2) It shall be open to Government to alter the above rates of bonus from time to time. (3) Every bonus amount shall be claimed by the Agent 2[and the stockiest] concerned by submitting a claim bill for the bonus amount in Form GSL-4 at the Sub-Treasury/District Treasury from which the prize winding ticket was issued to the Agent. 3 (6) Amount of bonus shall be claimed within three months from the actual date of draw. When the amount of bonus is not claimed within three months, it may be claimed by making an application stating the reason of delay to the Director of Lotteries who may authorise such payment of amount of bonus on merit of each case in a reasonable time]. 1. Section :- Tickets sold to Agents shall under no. circumstances be taken back by the Government. 21. Section :- Tickets of Bumper and monthly draws remaining unsold with the Government, shall not be eligible for prizes of amounts exceeding Rs. 1.000/- each. If an unsold ticket wins a prize of an amount exceeding Rs. 1,000, the fact shall be announced and the process of draw shall be repeated till the number of a sold tickets Winning prices of Rs. 1.000 (if any) and below are concerned, tickets remaining unsold with the Government shall also be eligible for such prizes which will remain with the Government. In case of Weekly draws, if an unsold ticket draws a prize (of any amount), the draw will not be repeated and the prize will remain with the Government. 22. Section :- No ticket shall be eligible for more than one prize in a draw. In the event of more than one prize being drawn by a particular ticket, the ticket holder shall be entitled only to the higher or the highest of the prizes drawn, on that ticket, as the case may be. 23. Section :- The time and place where the draw is to be held shall be given wide publicity. The draw shall be held in public and in the presence of a panel specially appointed by the Director to supervise the draw. For purposes of all draws, the panel consist of not less than three members including a Chairman and two members shall constitute the quorum. If for any reason the Chairman is unable to be present at the time of draw, the Director shall request any officer not below the rank of Collector or Deputy Collector or Deputy Secretary to Government or in their absence, suitable senior officer to act as Chairman. If for any reason the quorum is not constituted at the time of draw, the Director shall request any officer not below the rank of Deputy Collector or Under Secretary to Government or in their absence, a suitable senior officer to act as a member of the panel. 24. Section :- A list duly authenticated by the Director, indicating the notations of the series released for sale and a list of numbers issued in the series shall be made available to the panel. A list of tickets remaining unsold with the Government, shall also be drawn up by the Director and shall be duly authenticated and furnished to the paid before the draw commences. 25. Section :- The procedure for draws for each series shall be as follows:- (i) There will be six drums located in a conspicuous place at one end of the hall where a draw is conducted. The drums will bear the following identification labels: I..............II............III............IV.............V............VI ( L a k h s ) . . ( T e n thousands)..(Thousands)...(Hundreds)...... (Tens).......(Units) Drum No. 1 will contain a number of discs bearing digits 0, 1,2, etc. as the case may be, depending on the total number of tickets in a series. For example, if there are eight lakh tickets in a series, drum No. 1 will contain eight discs bearing digits 0 to 7, since in that case the tickets will be numbered consecutively from 000000 to 799999. The remaining drums will contain ten discs bearing digits 0 to 9. Each disc will be encased in a plastic pouch, so that the number on the disc cannot be seen. The draw will commence with the operation of all six drums simultaneously. When the Chairman rings the bell, the drums will be rotated for 10 to 15 seconds so that the plastic pouches containing the discs get well shuffled. When the Chairman rings the bell again, the drums will be halted. On halting the drums, one pouch from each drum will be picked up and taken to the Chairman, who will open it and announce the digit on the disc. The six digits respectively drawn from the drums I, II, III, IV, V and VI will be arranged on the Notice Board from left to right in the same sequence. (ii) As soon as a particular number is drawn, that is to say, after the digits constituting a number are drawn and posted on the Notice Board in the above manner, the number will be checked with the list of unsold tickets so far as the prizes exceeding Rs. 1,000 each are concerned and if the number represents an unsold ticket, the winning number shall be redrawn in the above manner till the number of a sold ticket is obtained. However, in case of Weekly draws list of unsold tickets will not be prepared and so, the redraw shall not be performed. In case of unsold tickets of Weekly draws winning prizes, they shall remain with the Government. The prize winning number will be entered in the register of prize winning numbers by the members of the panel in their respective copies. After the draw is over, the Chairman of the panel and all members of the panel will be required to sign the Chairman's copy of the register which will constitute the authentic record of the result. (iii) In respect of the prizes exceeding Rs. 1.000/- each for each series, the prize winning numbers shall be drawn in full as above. 1[(iv) in respect of prizes of Rs. 1.000/- or below, the prize- winning numbers will not be drawn in full but a combination of last digits four, five, etc. as may be necessary relating to the number of prizes looking to the number tickets will be drawn. All tickets whose numbers end with any one of these combinations will be eligible for prizes in all series. For example, if 500 prizes of Rs. 100/- each are to be given in each of 5 series of 10 lakhs tickets in each series the procedure will be as follows: A combination of last four digits will be determined by drawing digits from drums III, IV, V and VI in that order. All tickets whose number ends with any one of these combinations will be eligible for the said prize in all series}. (v) The common prizes 2 [or the First Prize/Prizes] in respect of any draw will be drawn last after the lucky numbers of all series are drawn. The procedure for drawing the common prize will be as follows:- Two sets of discs showing the notations of all the series will be kept in a drum and the lucky series will be drawn according to the procedure prescribed for drawing the lucky number. Thereafter the lucky number with lucky series will be drawn in the usual manner. The ticket in the lucky series and with the lucky number will win the common prize. In case the lucky number so drawn happens to be that of an unsold ticket in the lucky series, both the lucky series and the lucky number shall be treated as canceled and the lucky series and the lucky number therein shall both be drawn afresh in the above manner. This procedure shall be repealed till the number of a sold ticket is drawn. In case of Weekly draws, however, the drawn will not be repeated for this reason since the last of unsold tickets will not be prepared. 1. Pt. IV-B, dt. 8-10-82, p. 209. 26. Section :- After the draw is over, the various records shall be kept in the custody of the Director. 27. Section :- Wide publicity shall be given to the list of prize winning numbers. The list shall also be published in the Official Gazette and such publication shall constitute the official announcement of the result, for purposes of draw. R. 29 28. Section :- (1) Every prize amount shall be claimed by submitting a claim bill for the prize amount in Form GSL-5, together with the prize winning ticket. Winners of prizes exceeding Rs. 1.000/-, shall claim the prize amounts from the Director of State Lotteries only. Other prize may be claimed at any Sub-Treasury or District Treasury. It is not necessary for the prize winner to present the claim in person, nor is it necessary to have any identification of the prize winner. Payment will be made in the name of person who signs the claim bill, to which the prize winning ticket is attached. The prize amount can be claim bill, to which the prize winning ticket is attached. The prize amount can be claimed through a Scheduled Bank or a Co- operative Bank, having its office in the State, or if so requested in writing the amount can be sent to the claimant by money order after deducting, the money order commission or a cross or order cheque (wherever such facility is available can be handed over personally or sent by post. A ticket which is torn or mutilated will not ordinarily be considered as a valid ticket for any prize. Government may, however, consider such cases on merits at its discretion. 1(2) Agents also may disburse prizes of Rs. 1.000/- and below [against the winning tickets sold by them or by any other authorised agents] if the claims are made within 40 days from the date of draw excluding the date of draw.They shall not charge any commission from the buyers for this service. 2 (3) The agent who undertakes the disbursement of prizes of Rs. 1.000/- and below shall be paid 2% of the prize money disbursed by him as service charges. The agent shall be required to prefer the claim in Form GSL-5A for reimbursement of amount of prizes distributed by him along with the amount of service charges admissible on it. Section :- 1 [The prizes shall be claimed within sixty days from the date of draw excluding the date of draw. Where it is not so claimed it shall after that date but within a period of four months from the date of draw excluding the date of draw be claimed only by making a special application to the Director who may authorise payment of the prize amount on merits. Claims over four months but received within six months from the date of draw excluding the date of draw shall be authorised for payment by the Secretary to Government, Finance Department oh merits. Claims over Rs. 1.000/- received after six months from the date of draw excluding the date of draw shall be considered by Governments on merits]. All authorised Lottery agents shall be allowed a period of "5" days over and above the stipulated period for claiming prize amounts. Prize amounts not claimed within the aforesaid time limit as also the prize amounts in respect of claims rejected by the Director of State Lotteries or Secretary to Government Finance Department or Government shall lapse and the amounts shall automatically stand forfeited to the Government. 1. Section :- Notwithstanding anything stated in the foregoing it shall be lawful for Government to delegate, or permit delegation of powers vested in it, or any other authority under these rules to such officer for such purpose and subject to such conditions as it may specify by order in writing. 31. Section :- The Government reserves the right to after or modify the Rules/the terms and conditions governing the Gujarat State Lottery Scheme. Such charges will be notified in the Official Gazette, when necessary. The terms regarding prize amounts and procedure for draw of prize winning tickets shall not however be altered in respect of any draw after the commencement of sale of tickets for that draw. 32. Section :- If any question arises as to the interpretation of these rules or on any other matter not expressly provided for in these rules the matter shall be referred to Government and the decision of Government shall be final. 33. Section :- These rules shall constitute a binding contract between the Government and the Agents appointed thereunder and the persons who purchase lottery tickets issued hereunder and such a contract shall in each case be deemed to be made in the city of Ahmedabad, and no legal proceedings pertaining to any matter connected with this lottery scheme shall be instituted in any Court other than the appropriate Court in the city of Ahmedabad.
