Saving GUR (MOVEMENT CONTROL) ORDER, 1963 G.S.R. 1729, dated the 30th October, 1963.--In exercise of the powers conferred by sub-rule (2) of R.125 of the Defence of India Rules, 1962, the Central Government hereby makes the following Order, namely : 1. Short title and commencement :- (1) This Order may be called the Gur (Movement Control) Order, 1963. (2) It extends to the whole of India. (3) It shall come into force at once. 2. Definitions :- In this Order, unless the context otherwise requires,- (a) "Chief Director" means the Chief Director in the Directorate of Sugar and Vanaspati, Ministry of Food and Agriculture and includes an Officer on Special Duty, a Director and a Deputy Director in that Directorate; (b) "export" means to take or cause to be taken- (i) from any place within the region comprising- (a) the State of Andhra Pradesh and the Territory of Yanam in the Union Territory of Pondicherry; or (b) the State of Assam, the tribal areas specified in Part B of the Table appended to paragraph 20 of the Sixth Schedule to that Constitution and the Union Territories of Manipur and Tripura; or (c) the Slate of Gujarat, the territories of Daman and Diu in the Union Territory of Goa. Daman and Diu and the Union Territory of Dadra and Nagar Haveli; or (d) the State of Kerala and the Union Territory of Laccadive, Minicoy and Amindivi Island; or (e) the State of Madras and the territories of Pondicherry, Karaikal and Mahe in the Union Territory of Pondicherry; or (f) the State of Mysore and the territory of Goa in the Union Territory of Goa, Daman and Diu; or (g) the State of Punjab, the Slate of Jammu and Kashmir and the Union Territory of Himachal Pradesh; or (h) the State of West Bengal and the Union Territory of Andaman and Nicobar Islands, to any place outside that region; (ii) from any place within any other Stale to any place outside that other State; (c) "gur" means the article commonly known as gur, gul, jaggery, shakkar and rab includes uncrystallised sugar in any other form comprising original and convertible molasses and other impurities, inherent or foreign, prepared by boiling sugarcane juice with or without admixture of molasses or pure molasses; (d) "Import" means to take or cause to be taken into- (i) any place within any of the regions referred to in paragraph (i) of sub-clause (b) from any place outside that region; or (ii) any place within any other State from any place outside that other State. 3. Restrictions on export and import of gur :- (1) No person shall export or attempt to export or abet the export of cgur except under and in accordance with a permit issued in this behalf by the Chief Director or by the Government of the State or, as the case may be, by the Administrator of the Union Territory, from which the- gur is to be exported, or any officer authorised in this behalf by that Government or Administrator. (2) No person shall import or attempt to import or abet the import of gur except under and in accordance with a permit issued in this behalf by the Chief Director or by the Government of the State or, as the case may be, by the Administrator of the Union Territory, into which the gur is to be imported or any officer authorised in this behalf by the Government or Administrator. (3) The Central Government may, with respect to the export or import of gur from one State to another State, direct by notification in the Official Gazelle, that such export or import shall be by only such one or more of the following means, as is specified in such direction, namely: (a) by rail (b) by road; (c) by water; (4) Nothing in this clause shall apply to- (a) the export or import of gur- (i) on Government account; or (ii) under and in accordance with military credit notes; or (iii) forming part of ship stores intended for bona fide consumption during voyage; or (iv) not exceeding one kilogram as part of the personal luggage of a bona fide traveller; (b) the export of gur from the State of West Bengal to Bhutan or Sikkim or such export from any place in India to Nepal in pursuance of the Indo-Nepal Trade Agreement. 4. Powers of entry, search, seizure, etc :- Any person authorised in this behalf by the Central or State Government, or the Chief Director may, with a view to securing compliance with the Order or to satisfying himself that this Order has been complied with- (a) stop and search or authorise any person to stop and search any person, boat, motor or any vehicle or receptacle used or capable of being used for the export or import of gur; (b) enter and search or authorise any person to enter and search any place; (c) seize or authorise the seizure of any gur in respect of which he suspects that any provision of this Order has been, is being or is about to be contravened, along with the packages, coverings or receptacles in which sugar gur is found or the animals, vehicles, vessels, boats or other conveyances used in carrying gur and thereafter take or authorise the taking of all measures necessary for securing the production of the packages, coverings, receptacles, animals, vehicles, vessels, boats or other conveyances so used in a court and for their safe custody pending such production. 5. Saving :- Nothing in this Order shall apply to any gur which is in the course of transit from one State to another State at the commencement of this Order in so far as that transit is concerned.
