Repeal and saving SCHEDULE 1 :- SCHEDULE I SCHEDULE 2 :- SCHEDULE II SCHEDULE 3 :- SCHEDULE III SCHEDULE 4 :- SCHEDULE IV SCHEDULE 5 :- SCHEDULE V SCHEDULE 6 :- SCHEDULE VI SCHEDULE 7 :- SCHEDULE VII HAND PICKED SELECTED GROUNDNUTS (GRADING AND MARKING) RULES, 1982 Whereas a draft of the Hand Picked Selected Groundnuts (Grading and Marking) Rules, 1981 was published as required by Sec 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) on pages 2028 to 2043 of the Gazette of India; Part II, Section 3, sub-section (ii), dated the 27th June, 1961 under the notification of the Government of India in the Ministry of Rural Reconstruction, No. S.O. 1820, dated the 11th June, 1981, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of fortyfive days from the date of publication of the said notification in the Official Gazette; In exercise of the powers conferred by Section 3, of the said Act, the Central Government makes the following rules namely: 1. Short title, application and commencement :- (1) These rules may be called the Hand Picked Selected Groundnuts (Grading and Marking) Rules, 1982. (2) They shall apply to Hand Picked Selected groundnuts produced in India; (3) They shall come into force on the date of their publication in the Official Gazette. 2. Definition :- In these rules, unless the context otherwise requires,- (a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India; (b) "Authorised packer" means a person or a body of persons who has been issued certificate of authorisation by the Agricultural Marketing Adviser authorising such person or body of persons to grade and mark the Hand Picked Selected Groundnuts under Agmark. (c) "Schedule" means a schedule appended to these rules. 3. Grade designations :- The grade designations to indicate the quality of the Hand Picked Selected Groundnuts shall be as set out in column I of Schedules I to VI. 4. Definition of quality :- The quality indicated by the grade designations shall be as set out against grade designation in Schedules I to VI. 5. Grade designation mark :- (i) The grade designation mark shall consist of a label bearing a design consisting of an outline map of India with the word "AGMARK" and the figure of the rising sun with the words "Produce of India" and resembling the mark as set out in Schedule VII and specking the grade designation. (ii) The grade designation mark to be used on B-Twill jute bags, shall consist of a rectangular tie-on label specifying the grade designation. 6. Method of marking :- (i) the grade designation mark shall be securely affixed to each container in a manner approved by the Agricultural Marketing Adviser. (ii) In addition to the grade designation mark, every container shall be clearly marked with the following particulars namely: (a) date of packing; (b) lot number; (c) name of packer; (d) net weight; (e) place of packing; and (f) any other particulars as may be specified by the Agricultural Marketing Adviser. (iii) An authorised packer may, after obtaining the prior approval of the Agricultural Marketing adviser, mark his private trade mark on a container in a manner approved by the authorised officer, provided the private trade mark does not represent the quality or grade of the Hand Picked Selected Groundnuts different from that indicated by the grade designation mark affixed on the container in accordance with these rules. 7. Method of packing :- (i) Hand Picked Selected Groundnut shall be packed in new B-twill jute bags or in any other material as may be approved by the Agricultural Marketing Adviser. The packing material shall be clean, dry and free from any insect infestation or fungus contamination and also be free from any undesirable smell. (ii) The container shall be securely closed and sealed in the manner approved by the Agricultural Marketing Adviser. (iii) The package shall contain the Hand Picked Selected Groundnut of one trade description and one grade designation only. 8. Fumigation :- (i) Fumigation of Hand Picked Selected groundnut pods and kernels shall be compulsory. (ii) Export consignments shall be fumigated not earlier than 15 days before shipment. (iii) Fumigation of both Hand Picked Selected Groundnut pods and kernels and prophylactic treatment of container shall be undertaken in accordance with the instructions issued by the Agricultural Markeing Adviser to the Government of India from time to time and a certificate to this effect shall be produced by the exporter on his agent in respect of each lot in the form prescribed by the Agricutural Marketing Adviser to the Government of India to authority who issued the relevant Certificate of Grading, within 15 days from the date of shipment as a proof that the exported lot was fumigated by the recognised fumigator within the prescribed time. 9. Repeal and saving :- (1) The Hand Picked Selected Groundnuts (Grading and Marking) Rules, 1939 are hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the rules so repealed shall be deemed to have been done or taken under the corresponding provisions of these rules. Damaged discoloured pods.-Are those mechanically or by mould, weevil or any other insect attack or those showing internal discolouration materially affecting the quality. 4. Po pods of other than the principal variety/type of groundnut. 5. Shelling per cent.-Means the weight of kernels found in 100 gms of pods. HPS Groundnut under this grade shall be pac specific order from the foreign buyer indicating the number of counts (kernels) per 25 gms. NOTE: HPS Groundnut, meant for export shal only when there is specific demand from the foreign buyer. Slightly damaged.- Are those kernels which arc superficially affecting impair its appearance only. 3. Broken kernels.- Means the kernels smaller than splits but bigger than nooks. 4. Split kernels- Means the ke lengthwise into two complete halves only. 5. Nooks.- Means very small pieces of the kernels which are l/8th or less than l/8th of a whole Extraneous matter.- Means dust, dirt, stone, lumps of earth, shell, stem, straw or any other edible or non-edible seeds or any other impur has been provided to cover the buyers requirements in respect of "No. of kernels per 25 gms.' not covered under the other grades. HPS G grade shall be packed/exported only against specific order from the foreign buyer indicating the number of counts (kernels) per 25 gms. N Groundnut, meant for export, shall be subject to Aflatoxin test only when there is specific demand from the foreign buyer.
