Published in the Gazette of India, Extraordinary, Pt. II, Sec. 3(i), dated the 10th June, 1974. G.S.R. 263(E), dated the 6th June,1974.- In exercise of the powers conferred by Sec. 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order, namely: 1. Short title, extent and commencement :- (1) This Order may be called the High Speed Diesel Oil and Light Diesel Oil (Restriction on Use) Order, 1974. (2) It extends to the whole of India. (3) It shall come into force on the 10th day of June, 1974. 2. Definitions :- In this order, unless there is anything repugnant in the subject or context. "High Speed Diesel Oil" means any mineral oil (excluding mineral colza oil and turpentine substitute) which has its flash point at or above twenty-five degrees of Centigrade thermometer, and satisfies either of the following requirements, namely : (i) the oil has a smoke point of ten milimetres or more but less than twenty milimetres, or (ii) oil has a smoke point of less than ten milimetres but has a viscosity of less than fifty seconds by Redwood I Viscometer at 37.8 degrees of Centigrade thermometer, and satisfies the following conditions, namely:- (a) the oil leaves carbon residue of less than 1/4 per cent. by weight when tested by Ramsbottom carbon Residue Apparatus, and (b) the oil is lighter in colour than 0.04 Normal Iodine solution when tested by colour comparison test. But this does not include-- (a) base mineral oils (suitable for use in the manufacture of lubricating oils and greases), including mineral oils commonly known as transformer oil base stock or Transformer oil feed stock, and (b) Lubricating oils including spindle oils, flushing oils and jute batching oils. "Light Diesel oil" means any mineral oil which:- (i) has a smoke point of less than ten millimetres; (ii) possesses a viscosity of less than one hundred seconds by Red wood I Viscometer at 37.8 degrees of Cenirigrade thermometer: (iii) leaves carbon residue of not less than 1/4 per cent. by weight when tested by Rarnsbottom carbon Residue Apparatus, and - (iv) is as dark as, or darker than, 0.04 Normal Iodine solution when tested by colour, comparison test. 3. Restriction on use of high speed diesel oil and light diesel oil :- No person shall, without the previous permission in writing of the State Government or any officer authorized by it in this behalf, use o r permit the use of high speed diesel oil or light diesel oil in generating electricity for the purpose of providing electric lighting on any festive occasion. 4. Power of entry, search and seizure :- 1 [(1)] Any police officer not below the rank of 2[Sub-Inspector] or any other officer of Government of or above an equivalent rank authorized in this behalf by the State Government may, with a view to securing compliance with this Order or to satisfying himself that this Order or any order made thereunder has been complied with- (a) enter and search any place, premises, or vessel, which, the officer has reason to believe, has been, is being, or is about to be, used for the contravention of this Order or any order made thereunder; (b) seize stocks of high speed diesel oil or light diesel oil in respect of which he has reason to believe that contravention of the provisions of the Order or of any order made thereunder has been, is being, or is about to be, made. 3 [(2) The provisions of S.100 Code Of Criminal Procedure, 1973, relating to search and seizure shall, so far as may be, apply to searches and seizures under this Order.] 1.
