Saving Indian Bar Councils (Madras Amendment) Act, 1954 35 of 1954 [19 January 1955] PREAMBLE An Act further to amend the Indian Bar Councils Act, 1926, in its application to the State of Madras. WHEREAS it is expedient further to amend the Indian Bar Councils Act, 1926 (Central Act XXXVIII of 1926), in its application to the State of Madras, for the purposes hereinafter appearing; Be it enacted in the Fifth Year of the Republic of India as follows:-- 1 For Statement of Objects and Reasons, see Fort St. George Gazette Extraordinary, dated the 6th December 19541, Part 321- 322, This Act has been validated by the Bar Councils (Validation of State Laws) Act, 1956 (Central Act 4 of 1956) 1. Short title and extent :- (1) This Act may be called the Indian Bar Councils (Madras Amendment) Act, 1954. (2) It extends to the whole of the State of Madras. 2. Insertion of new section 4-A in Central Act XXXVIII of 1926 :- In the Indian Bar Councils Act, 1926 (Central Act XXXVIII of 1926), after section 4, the following section shall be inserted, namely: "4-A. Qualifications for election.-- Notwithstanding anything contained in this Act or in any rule made thereunder, no advocate entered in the roll of advocates of the Madras High Court who, on or after the 5th July 1954, is not ordinarily raiding and practising in Courts in the State of Madras shall be entitled to vote at any election for, or to be elected to, the Madras Bar Council under clause (c) of sub-section (1) of section 4." 3. Saving :- For the avoidance of doubt, it is hereby declared that nothing contained in this Act shall affect the right of any advocate entered in the roll of advocates of the Madras High Court to practise in that High Court or in any Court subordinate thereto.
