Repeal Of Sections 25 And 26 Of The Limitation Act, 1963 Indian Easements (Orissa Extension) Act, 1967 An Act to extend the Indian Easements Act, 1882 to those areas of the State of Orissa to which it does not extend and to enforce it in the said areas Be it enacted by the Legislature of the State of Orissa in the Eighteenth Year of the Republic of India, as follows : Statement of Objects and Reasons-Law Commission, in their Third Report, have recommended that the Indian Easements Act, 1882 should be extended to those States when it is not in force, with large scale urbanisation and consequent growth of consciousness in respect of proprietary rights over small urban holdings the right of user is frequently being asserted in the Courts. It is desirable to have a comprehensive legislation dealing with all matters connected with easements and rights in respect thereof. It is, therefore, proposed that the Indian Easements Act, 1882 should be extended by an Act to those areas of the State where it is not in force. With the enforcement of the Indian Easements Act, 1882. Sections 25 and 26 of the Limitation Act, 1963 will have to be repealed. The Bill seeks to achieve the above purpose. Short Title :- This Act may be called the Indian Easements (Orissa Extension) Act, 1967. 2. Extension Of Indian Easements Act, 1882 To The State Of Orissa :- The Indian Easements Act, 1882 shall extend to those areas of the State of Orissa to which it did not extend immediately prior to the coming into force of the Act and shall come into force in the said areas at once. 3. Repeal Of Sections 25 And 26 Of The Limitation Act, 1963 :- Sections 25 and 26 of the Limitation Act, 1963 in so far as they apply to State of Orissa are hereby repealed.
