Rule 10 Indian Forest Service (Gujarat Cadre) (Departmental Examination) Rules, 1998 In pursuance of clause (c) of rule 2 of the Indian Forest Service (Pay) Rules, 1968 the Government of Gujarat hereby makes the following rules for passing the Departmental Examination for the members appointed to the junior time scale of Indian Forest Service, allotted to the cadre of the Indian Forest Service of the Gujarat State or posts to the Gujarat State, as follows, namely: 1. Rule 1 :- (1) These rules may be called the Indian Forest Service (Gujarat Cadre (Departmental Examination) Rules, 1998 . (2) They shall apply to persons appointed to the Indian Forest Service allotted to the cadre of the Indian Forest Service of the Gujarat State under clause (a) o sub-rule (2) of R.4 of the Forest Service (Recruitment) Rules, 1966. 2. Rule 2 :- In these rules, unless the context otherwise requires : (a) "Appendix" means an appendix appended to these rules; (b) "Appointed date" means the date on which these rules shall come intc force; (c) "direct recruit" means a person appointed under clause (a) of sub-rule (2) of R.4 of the Forest Service (Recruitment) Rules, 1966; (d) "Examination" means the examination prescribed under these rules; (e) "Specified period" means the period specified in these rules for passing the examination. 3. Rule 3 :- A direct recruit shall have to pass the examination within the period of four years from the date of his appointment in the Indian Forest service: Provided that if the period of passing the examination expires before the date of the holding of the examination, the said period shall be deemed to have been extended until the date of the examination so held: Provided further that where any such person before the appointed date, has passed the examination or has been exempted from passing the examination, he shall not be required to pass the examination as provided in these rules. 4. Rule 4 :- The examination shall be held twice in a year, ordinarily be held in the month of January and July, by the Principal Chief Conservator of Forests, Gujarat State, Gandhinagar. 5. Rule 5 :- The syllabus for the examination shall be as specified in Appendix 'A'. 6. Rule 6 :- A direct recruit who intends to appear at the examination shall send his application for candidate-ship to the Principal Chief Conservator of Forest through concerned Consevator of Forest in the form prescribed in Appendix 'B' atleast 60 days before the date of commencement of the examination. The Principal Chief Conservator of Forest shall scrutinize the application with regard to the eligibility for appearing at the examination and shall admit the candidate to the examination on the strength of the certificate given by the concerned Conservator of Forest that they are eligible to appear at the examination. If the applicant subsequently decides not to appear at the examination, he shall give intimation thereof to the Principal Chief Conservator of Forests, at least 30 days before the date of the commencement of the examination. In the event of any person failing to appear at the examination after having enrolled his name as a candidate for appearing at the examination without intimating as aforesaid, he shall be deemed to have exhausted a chance to appear at the examination: Provided that the State Government may condone the failure on the part of any person to send intimation as aforesaid and the consequences arising therefrom, is satisfied that the person has failed to send intimation within the prescribed time limit for the reasons beyond his control. 7. Rule 7 :- (1) The standard for passing the examination shall be 50% of the total marks in each paper, irrespective of whether they are to be answered with or without the help of books. (2) An unsuccessful candidate who secure 60% or more marks in any one or more papers shall be exempted from appearing in those paper at the subsequent examinations. (3) A candidate who appears for all the papers at one and the same examination, but fails to obtain in any one paper the minimum number of marks required for passing shall be allowed condonation of the deficiency of marks in that paper, provided such deficiency does not exceed five percent of the total number of marks obtainable in that paper. 8. Rule 8 :- The intimation regarding place and programme of the examination shall be communicated by the Principal Chief Conservator of Forest to the Secretary, Government of Gujarat, Forest and Environment Department and to all the candidates. 9. Rule 9 :- The result of the examination shall be published by the Principal Chief Conservator of Forests in the Gujarat Government Service. 10. Rule 10 :- During the examination time, in the examination hall, if any candidate is found coping or allowing others to copy in answer book from unauthorised publication or any other private books bearing explanatory notes, or pamphlets or any other kind of notes or found violating the instructions of representatives of the Principal Chief Conservator of Forests and creating hinderence in handling the examination by making arguments with the examiners of the Principal Chief Conservaors of Forests, the Principal Chief Conservator of Forests shall take punitive steps against the candidate as under ; (a) Such candidate or candidates shall be immediately expelled from the examination hall by the representative appointed by the Principal Chief Conservator of Forests. (b) The representative of the Principal Chief Conservator of Forests shall submit the report to the Principal Chief Conservator of Forests against such candidate or candidates. (c) The Principal Chief Conservator of Forests shall consider the report of his representatives against such candidate or candidates "Fail" all the papers even though they appeared in the examination.
