Repeal And Saving Jharkhand Panchayat Raj (Amendment) Act, 2005 6 of 2006 AN ACT To Amend The Jharkhand Panchayat Raj Act, 2001 (Jharkhand Act 06, 2001) Enacted by the Jharkhand Assembly in the Fifty-sixth year of Republic of India as Follows:- 1. Short Title Extent And Commencement :- (i) This Act, may be called Jharkhand Panchayat Raj (Amendment) Act, 2005; (ii) It shall extend to the whole of the state of Jharkhand State; (iii) It shall come into force at once. 2. Amendment Of Section 2 Of The Jharkhand Act 06, 2001 :- After Section 2 (i) of the Jharkhand Panchayat Raj Act, 2001 (Jharkhand Act 06, 2001), following proviso shall be added, as "Provided that Population of other backward classes means the population of other backward classes ascertained on the basis of last preceding Census figures by the procedure prescribed by the State Government;" Provided further, that if the State Government has not ascertained the population of other backward classes on the basis of last preceding Census figures as per the prescribed procedure then the population of other backward classes is deemed to be assessed by assuming the villagewise percentage population of other backward classes, as ascertained by survey on the basis of figures just preceding to the last preceding census fixed. 3. Repeal And Saving :- (1) The Jharkhand Panchayat Raj (Amendment) Ordinance, 2005 (Jharkhand Ordinance 01, 2005) is hereby repealed. (2) Notwithstanding such repeal, any thing done or any action taken in exercise of any power conferred by or under the said Ordinance shall be deemed to have been done or taken on exercise of the powers conferred by or under this Act, as of this Act were in force on the date on which such thing was done as action taken.
