Repeal and savings KARNATAKA SELECTION OF CANDIDATES FOR ADMISSION TO NURSING, PHARMACY AND PHYSIOTHERAPY COURSES RULES, 2003 Whereas, the draft of the Karnataka Selection of Candidates for admission to Nursing, Pharmacy and Physiotherapy Courses Rules, 2003 was published as required by sub-section (1) of Section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995), in Notification No. HFW 44 MPS 2003, dated 13-6-2003 in Part IV-A of the Karnataka Gazette, Extraordinary, dated 13-6-2003, inviting objections and suggestions from the persons likely to be affected thereby and notice was given that the said rules will be taken into consideration after fifteen days from the date of its publication in the Official Gazette. Whereas, the said Gazette was made available to the public on 13th June, 2003. And whereas, objections and suggestions received have been considered. Now, therefore, in exercise of the powers conferred by Section 14 of the Karnataka Educational Institutions (Prohibition of Capitation Fee) Act, 1984 (Karnataka Act 37 of 1984), and Section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995), the Government of Karnataka hereby makes the following rules, namely: 1. Title, commencement and application :- (1) These rules may be called the Karnataka Selection of Candidates for Admission to Nursing, Pharmacy and Physiotherapy Courses Rules, 2003. (2) They shall come into force on the date of their publication in the Official Gazette. (3) These rules shall apply to the selection of candidates for admission to the following courses, namely. (a) Bachelor of Nursing; (b) Bachelor of Pharmacy; and (c) Bachelor of Physiotherapy. (4) These rules shall not apply to candidates (including foreign candidates) sponsored by the Ministry of Human Resource Development, Government of India. 2. Definitions :- In these rules, unless the context otherwise requires. (a) "Aided Institution" means any institution which receives Grant- in-Aid from the Government; (b) "Allotment Centre" means a centre at which the allotment of candidates to various institutions is made; (c) ''Director" means the Director of Medical Education in Karnataka; (d) "Ex-serviceman" means a person who has served in any rank whether as a combatant or non-combatant in the regular army, navy or air force of the Indian Union; and (i) who retired from such service after earning his pension; or (ii) who has been released from such service on medical ground attributable to military service or circumstances beyond his control and awarded medical or other disability pension; or (iii) who has been released, otherwise than on his own request, from such service as a result of reduction in establishment; or (iv) who has been released from such service after completing the specific period of engagement, otherwise than at his own request or by way of dismissal or discharge on account of misconduct or inefficiency and has been given a gratuity, and includes personnel of the territorial army of the following categories, namely. (a) pension holders for continuous embodied service; (b) pension holder with disability attributable to military service; and (c) gallantry award winners; Provided that a person who has served for not less than five years and was honourably discharged prior to 1st July, 1987 will also be considered as an Ex-serviceman. (e) "Freedom Fighter or Political Sufferer" shall have the same meaning as defined in G.O. No. ED 73 TEC 85, dated 27th November, 1985; (f) "Gadinadu Kannadiga" means a candidate whose mother tongue is Kannada or Tulu or Kodava and who resides in Kan- nada speaking areas of South Sholapur or Akkalkot or Jath of Gadhinaglaj Taluk of Maharashtra State or Kasargod Taluk of Kerala State; (g) "Government" means the Government of Karnataka; (h) "Government seats" means the Government seats referred to in ciause (a)- f sub-rule (1) of Rule 4, and it shall be divided into: (i) Category I. Consisting of seats specified in sub-clause (1) of clause (a) of sub-rule (1) of Rule 4 and 50% of the total intake of seats in unaided private colleges and 25% of the intake of seats in religious and linguistic minority institutions in respect of which concessional fee is allowed; (ii) Category II. Consisting of 15% of the total intake of seats in Private unaided Private Colleges and 25% of the total intake of seats in minority institutions to be filled by the candidates within Karnataka on the basis of merit without concessional fee; (iii) Category III. Consisting of ten per cent of total intake in unaided private colleges to be filled from outside Karnataka without any fee concession; (i) "Horanadu Kannadiga" means a candidate whose mother tongue is Kannada or Tulu or Kodava and who is residing outside the State of Karnataka but within the territory of India, as on 1st May of the year and such candidate should have passed the qualifying examination from an University or Board or any other institution located outside Karnataka but within the territory of India; (j) "Institution" means any educational institution carrying on the activity of imparting education in B. Pharm and B.Sc. (Nursing) or Bachelor of Physiotherapy leading to a degree conferred by the Rajiv Gandhi University of Health Sciences; (k) "Intake" means the sanctioned strength of a course fixed by the affiliating authority; (l) "Pre-University Examination" means the second year examination of the Pre-University Course conducted by the Department of Pre-University Education of the State of Karnataka; (m) "Qualifying Examination" means the second year examination of the Pre-University Course or other examination declared as equivalent to Pre-University examination in case of admission to 1st year of B.Pharm, B.Sc. (Nursing) and Bachelor of Physiotherapy Degree Courses or final year D.Pharm examination approved by Board of Examining Authority, Karnataka State or any other State Board approved by the Pharmacy Council of India in case of admission to II year B.Pharm Course; (n) "Unaided institution" means any privately managed institution which is not an Aided Institution; (o) "University" means the Rajiv Gandhi University of Health Sciences established under the Rajiv Gandhi Health Sciences University Act, 1994 (Karnataka Act 44 of 1994). 3. Academic Eligibility :- No person shall be eligible for admission to full-time Degree Courses under these rules, unless he. (1) has passed the Second Year Pre-University Course with Physics, Chemistry and Mathematics or Physics, Chemistry and Biology in respect of admission to I year B.Pharm Course and has obtained not less than 50% of the aggregate marks in the optional subjects with English as one of the languages, and in case of admission to B.Sc. (Nursing) Course and Bachelor of Physiotherapy has passed Second Year Pre-University with Physics, Chemistry and Biology as optional subjects with English as one of the languages and has obtained not less than 45% of the aggregate marks in the optional subjects: Provided that the minimum marks for the purpose of eligibility shall not be less than forty per cent of the aggregate marks in the optional subjects in case of candidates belonging to the Scheduled Castes and Scheduled Tribes and Category I of other Backward Classes as specified in the relevant Government Order for the purpose of reservation in Bachelor of Nursing, B.Pharm and Physiotherapy Courses; (2) is a holder of Diploma in Pharmacy granted by the Board and has obtained not less than sixty per cent of the aggregate marks of D.Pharm, (Part I) and D.Pharm, (Part II) examination for admission to II Year B.Pharm Course as per the Regulations made by the All India Council for Technical Education: Provided that the minimum marks for the purpose of qualification specified above shall not be less than forty per cent in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and Category I specified in the relevant Government Order for the time being in force. 4. Allotment of seats :- (1) The seats under these rules shall be classified as Government seats and Management seats and sharing of seats shall be as follows. (a) The Government seats shall be. (i) all the sanctioned intake seats in Government Colleges; (ii) seventy-five per cent of the total intake in Unaided institutions, out of which fifty per cent of the total intake shall be filled from the candidates eligible for Category I Government seats on the basis of merit-cum-reservation and twenty-five per cent of the total intake shall be filled on the basis of merit out of which fifteen per cent of the total intake shall be filled by the candidates eligible for Category II of Government seats and the remaining ten per cent of the total intake by the candidates eligible for Category III of Government seats; (iii) fifty per cent of the total intake of seats in religious and linguistic minority colleges out of which twenty-five per cent of the total intake shall be filled from the candidates eligible for Category I of Government seats on the basis of merit-cum-reservation and twenty-five per cent of the total intake shall be filled by candidates on the basis of merit who are eligible for Category II of Government seats. (b) Management seats shall be as follows. (i) twenty-five per cent of the total intake in Private unaided colleges; (ii) fifty per cent of the total intake in religious and linguistic minority colleges out of which thirty-five per cent of the total intake shall be filled by the management from the concerned religious or linguistic minority candidates only. (2) All the Government seats shall be filled through the Selection Committee under these rules. (3) The management may fill the management seats on merit basis. (4) The management may fill such number of Government seats as are remaining unallotted or unfilled by the Selection Committee after the reconciliation meeting and within the last date fixed for admission by Rajiv Gandhi University of Health Sciences. 5. Eligibility for Categories I and II of Government seats :- A l l Categories I and II Government seats shall be filled by candidates who satisfy one of the following conditions, namely. (1) A candidate should have studied and passed in one or more Government or Government recognised educational institutions located in the State of Karnataka for a minimum period of Seven academic years commencing from 1 standard to II PUC or 12th standard as on 1st July of the year and should have appeared and passed SSLC or 10th standard or II PUC or 12th standard or equivalent examination from institution located in the State of Karnataka: Provided that candidate who takes more than one year to pass a class or standard, the years of academic study is counted as one year only. (2) A candidate should have studied and passed I and II year Pre- University Examination or equivalent examination, within the State of Karnataka from an educational institution run or recognized by the State Government and that either of his parents should have studied in an educational institution run or recognised by the State Government and located in the State of Karnataka for a minimum period of seven years. (3) The candidate is a Horanadu Kannadiga: Provided that the candidate shall undergo a simple Kannada language test conducted by Selection Committee, to prove his/her ability to speak, read and write Kannada. (4) The candidate is a Gadinadu Kannadiga: Provided that the candidate shall undergo a simple Kannada language test conducted by Selection Committee, to prove his or her ability to speak, read and write Kannada. (5) In case of a candidate who is a son or daughter of a defence personnel who worked continuously in Karnataka as on any day for a minimum period of one year from 1st July of the previous year to 30th June of the year of admission, the candidate should have studied and passed the qualifying examination from any Government or Government recognised institutions located in Karnataka. (6) In case of a candidate who is a son or daughter of serving defence personnel who at the time of joining the defence service had declared his/her home town a place in the State of Karnataka, proof of such domicile having been produced by obtaining the extract from the Record Office of the Defence Unit. (7) In the case of a candidate who is a son or daughter of a defence personnel who had served in Karnataka for at least one year and is posted on duty directly to the disturbed areas of Jammu and Kashmir or North-East and whose family is permitted by the Defence Authorities, to continue to stay in Karnataka and such candidate has studied and passed the qualifying examination from any Government or Government recognised institution located in Karnataka. (8) In case of a candidate who is a son or daughter of an Ex- serviceman who at the time of joining the defence service had declared a place in Karnataka as his home town, proof of such domicile having been produced from the Rajya Sainik Board. (9) In the case of a candidate being a son or daughter of an employee of Union Government or employee of the Union or Karnataka State Government undertaking or a joint sector undertaking, who is liable to transfer anywhere in India as per terms and conditions of his/her employment, has worked continuously for at least one year in Karnataka as on any day from first July of the previous year to thirtieth June of the year of admission and such candidate has studied and passed the qualifying examination from any Government or Government recognised educational institution located in Karnataka. (10) Son or daughter of a working or retired employee of the Union Government or employee of Central or Karnataka State Government undertaking or joint sector undertaking where such employee. (a) had declared to the employer at the time of joining service any place in Karnataka to be his home town; and (b) had studied in any Government or Government recognised educational institution or institutions located in Karnataka for not less than seven years at any time between 1st standard to 12th standard or Pre- University examination; and (c) was or is liable for transfer anywhere in India as per the terms and conditions of his employment. (11) Son or daughter of Members of Parliament elected from Karnataka. (12) Son or daughter of serving or retired employee. (a) of All India Service of Karnataka Cadre; or (b) of the Government of Karnataka who has served or is serving outside the State of Karnataka, during the period corresponding to candidates study outside the State from I Standard to II PUC or XII Standard examination. 6. Determination of merit :- The merit shall be determined by taking the marks obtained in the optional subjects, as the case may be, in the Second Year PUC or equivalent examination in case of admission to the 1st Year B.Sc. (Nursing), B.Pharm and Bachelor of Physiotherapy. In respect of candidates possessing Diploma in Pharmacy, selection for admission to 2nd Year B.Pharm Course shall be on the basis of aggregate marks of D.Pharm (Part I and Part II) examinations. Explanation. For the purpose of these rules, optional subjects means Physics, Chemistry and Mathematics or Biology for the Bachelor of Pharmacy Course and Physics, Chemistry and Biology for the Bachelor of Nursing and Bachelor of Physiotherapy Courses: Provided that where the merit of two or more candidates is the same, the merit shall be determined with reference to the marks obtained in qualifying examination in Chemistry in case of admission to 1st year B.Pharm and marks obtained in Chemistry of 2nd year Pre-University Examination in case of admission to 2nd year B.Pharm Course and in Biology in case of admission to B.Sc. (Nursing) and Bachelor of Physiotherapy courses and where the marks obtained are equal, the merit shall be determined on the basis of age of the candidate, the older candidate being placed above the younger. 7. Procedure for selection of candidates :- The procedure for the selection of candidates for admission to institutions against Government seats shall be as follows. (1) The Director shall publish on the Notice Board of his office and in such other office as he may think fit and also by giving publicity in at least one Kannada and one English newspapers having wide circulation in the State, and call for duly completed applications for admission to First year B.Pharm, First year B.Sc. in Nursing and Bachelor of Physiotherapy Courses, for all seats in all the institutions in the State, giving briefly such information as to particulars of courses, the number of seats available as Government seats and Management seats, the names and location of institutions, minimum eligibility conditions, reservation of seats, method of admission, place where the prescribed application form along with the brochure containing the above details will be available and such other information as he considers necessary and fixing the last date and time for receipt of the application. The Director shall also similarly give such publicity as necessary and call for applications with such information as may be required for seats reserved for Kannadigas outside Karnataka. No application shall be entertained after the last date so fixed. (2) Separate application forms may be specified for different courses of studies. The Director shall also indicate the various certificates, affidavits, marks cards, etc., which are required to be produced at the time of admission to an institution after selection. (3) A candidate possessing qualification declared as equivalent to the Karnataka Pre-University examination shall produce at the time of his admission, copy of the order in which such qualification has been declared as equivalent to the said Pre-University examination. (4) Applications wherever called for should be legibly and properly filled, strictly as per the instruction given to the candidates. Where the required certificates and affidavits as specified are not enclosed such applications shall be liable to be rejected. (5) The Director shall enter the details of every application received by him upto the last date fixed for receipt of application irrespective of whether it is valid or invalid under these rules in a register. This register shall be called as the "Register of Applications Received". 8. Mode of selection to Government seats :- (1) The Director shall prepare a list of candidates for selection from the Register of Applications Received in the order of merit determined under Rule 6 and in the order of reservation prescribed under Rule 9. (2) The Director shall, for the purpose of allotment of seats, cause publication of the details of counselling as to the place, date, time, etc., in one or more leading newspapers having wide circulation in the State for the information of the intending candidates. (3) The Selection Committee constituted under Rule 11 shall call for Counselling each day a specified number of candidates from the list prepared under sub-rule (1) above. Every candidate shall be required to give his choice of course and institution at the counselling. (4) Each candidate shall pay the fee prescribed for I and II year of Bachelor of Pharmacy, I year of Bachelor of Nursing and Physiotherapy Courses to the allotted colleges at the time of admission. The Selection Committee shall cause verification of all the original documents produced by the candidate and after ascertaining that the documents so produced are proper and in order, he shall issue allotment order to the candidate as per the rank and choice of the candidate and with reference to the vacancy position obtained at the time of allotment. The allotment order shall contain the details of institution and course to which the candidate is allotted and also the category of seats to which he has been allotted. Once the allotment order is issued, it shall be final, and the candidate shall not have any more opportunity to exercise his option again for change. (5) With the issue of allotment order, the candidate shall be deemed to have been finally admitted. (6) After getting the allotment order, each candidate shall join the respective institution to which he is allotted within the period specified. If the candidate fails to join within the said specified period, his allotment shall automatically stand forfeited without any further notice to the candidate. Vacancies, thus arising shall be filled by the Selection Committee from among the candidates remaining in the list prepared in accordance with sub-rules (1) and (2). It shall be binding on the institutions to allow the candidates allotted by the Selection Committee to join the institutions to which they are allotted. (7) After the last date fixed for the candidates to join the institutions to which they are allotted, the Principals of the respective institutions shall send the list of candidates who have joined, to the Director within one week therefrom. 9. Reservation applicable to Category I of Government seats :- (1) Seats shall be reserved in Category I of Government seats for the following categories the extent of which shall be specified by the Government from time to time, namely. (A) Candidates. (1) who have participated in Republic Day Camp conducted by the Directorate General of NCC, New Delhi from Karnataka and who possess at least 'B' certificate under NCC obtained during the five years period of studying in Karnataka between VIII to XII standards; or (2) who have participated in the following camps conducted by the Directorate General of NCC, New Delhi from Karnataka and who possess at least 'B' certificate under NCC obtained during the five years period of study in Karnataka between VIII to XII standard, namely. (a) Independence Day Camp; (b) Basic Leadership Camp (Girls); (c) Nau Sainik Camp; or (d) Basic Leadership Camp (Boys); (e) Vayu Sainik Camp; (3) who possess at least 'B' Certificate under NCC obtained during the five years period of study in Karnataka between VIII to XII Standard: Provided that the candidates referred to in sub-clause (1) shall be concerned first before considering candidate referred to in sub- clause (2) who will be considered before considering candidates referred to in sub-clause (3) above: Provided further the candidates possessing 'B' Certificate and adjudged BEST CADET in camps mentioned in sub-clause (1) shall have precedence over all other candidates seeking admission under that sub-clause and the candidates adjudged 'BEST CADET' in camps mentioned in sub-clause (3) shall have precedence over all other candidates seeking admission under that sub-clause. (B) Candidates (1) Who have represented country in international level events specified in Schedule during the five years period and won medals, cups or plates in games or sports during five years period of study in Karnataka between VIII and XII standards; and (2) Who have represented Karnataka State in national level events specified in Schedule during the five years period and won medals, cups or plates in games or sports during five years period of study in Karnataka between VIII and XII Standards; and (3) Who have represented Karnataka State in any sports or games in the national level events specified in Schedule during five years period of study in Karnataka between VIII and XII Standards: Provided that candidates covered under sub-clause (1) shall have the first option to select the seat under these rules and the candidates covered under sub-clause (2) shall exercise their option n e x t and the candidates covered under sub-clause (3) shall exercise their option only for the seats, if any, remaining. (C) Candidates who as Scouts/Guides have received the "President award" during five years period of study in Karnataka between 8th and 12th standards. (D) Son or daughter of defence personnel. Explanation. Subject to the conditions laid down in clauses (5), (6) and (7) of Rule 5, 'Defence Personnel' for the purpose of this clause means a person in Defence Service including Personnel belonging to Civil GT COYS ASC who were Civilian Class 'III' or Class TV' Government servants "and border roads organisational personnel". (Vide Notification No. ED 189 TGL 94, Bangalore, dated 29-7- 1994.) (E) Son or daughter of Ex-servicemen. Explanation. Ex-servicemen for the purpose of this clause includes personnel belonging to Civil GT COYS ASC who were civilian Class III or Class IV Government servants, who became permanently disabled or were killed during hostilities. (F) Candidates who are persons with disability. (G) Candidates from Anglo-Indian community. (2) Out of the total number of Category I of Government seats available in accordance with Rule 4 in full-time courses for candidates deducting the total number of seats reserved under sub-rule (1), reservation shall be made in favour of candidates belonging to the Scheduled Castes, Scheduled Tribes and other backward classes as notified by the Government of Karnataka under Categories I, II-A, II-B, III-A and III-B, in accordance with Government Order No. SWL 251 BCA 94, dated 31st January, 1995 and as amended from time to time: provided that no candidate other than those who are claiming eligibility for Category I of Government seats in accordance with clauses (1), (2), (8), (10), (11) and (12) of Rule 5 shall be eligible to claim the benefit of reservation under this sub-rule. (3) Fifteen per cent of Category I of Government seats shall be reserved horizontally in favour of rural candidates and the eligibility criteria shall be as defined in the Karnataka Reservation of Appointments or Posts in the Civil Services of the State for Rural Candidates Act, 2000 (Karnataka Act 1 of 2001). (4) Five per cent of the Category I of Government seats shall be reserved horizontally for allotment to the candidates who have studied in Kannada Medium in accordance with Government Order No. ED 91 URC 2002, Bangalore, dated 31-7-2002 and amended from time to time. (5) Inter se merit determined under Rule 6 shall remain the same for availing benefit of reservation under this rule. (6) If any seat reserved in favour of candidates belonging to the categories referred to in sub-rules (3) and (4) is not filled up due to non-availability of eligible candidates belonging to such category such vacant seats shall stand transferred to the respective categories specified in sub-rule (2). 10. Reservation of seats under Category I of Government seats in respect of B.Pharm Course :- (1) Out of the seats available under Category I of Government seats in Government College of Pharmacy, two seats shall be reserved for Government of India nominee for admission to 1st Year B.Pharm Course. (2) (i) In case of admission to II Year B.Pharm Course in Government College of Pharmacy, ten per cent of the sanctioned intake of 1st Year B.Pharm Course shall be reserved for in service candidates who are serving in Health and Family Welfare Department and who are D.Pharm holders. The inservice candidates. (a) must have obtained not less than 60% of the aggregate marks of D.Pharm (Part I and Part II) examinations; (b) must have completed probation period satisfactorily; (c) must have put in not less than 5 years of regular service; (d) must not have attained the age of 48 years as on the date of issue of notification calling applications. (ii) There shall be a Selection Committee to select the inservice candidates for admission to II Year B.Pharm Course in Government College of Pharmacy which shall consist of the following. (a) The Director of Medical Education - Chairman/Chairperson (b) The Director of Health and Family Welfare Services - Member (c) The Principal, Government College of Pharmacy - Member (d) Deputy Director of Medical Education Member-Secretary (iii) The selection of inservice candidates shall be made on the basis of seniority: Provided that 15% of the seats shall be reserved for the persons belonging to the Scheduled Castes and 3% for Scheduled Tribes. (iv) Inservice candidates who are selected for II Year B.Pharm Course shall be considered for deputation to the course or for sanction for study leave in accordance with the provisions of the Karnataka Civil Services Rules. (v) Inservice candidates after selection at the time of admission furnish a bond in the form specified by the Selection Committee on a stamp paper of Rs. 100/- binding himself to pay a sum of Rs. 10,000/- as a penalty and automatically debarred from applying to II year B.Pharm course for the next 3 Years in the event of his leaving Course before its completion. (3) (i) In case of Private Pharmacy Colleges, ten per cent of the sanctioned intake of I Year B.Pharm Course shall be reserved as seats for admission to II Year B.Pharm Course for D.Pharm holders who have obtained not less than 60% of aggregate marks of D.Pharm (Part I and Part II) examinations. These seats shall be divided as follows. (a) Categories I, II and III seats (Government seats) as given under clause (h) of Rule 2; (b) Allotment shall be made in accordance with the provisions contained in sub-clauses (ii) and (iii) of clause (a) of sub-rule (1) of Rule 4. 11. Selection Committee and its functions :- (1) There shall be a Selection Committee consisting of the following. For Bachelor of Physiotherapy :- 1.Director of Medical Education - Chairperson 2.Principal of Bangalore Medical College - Member 3.Professor and HOD (Orthopedics), Bangalore Medical College, Bangalore - Member 4.Deputy Director of Medical Education - Member-Secretary For B.Sc (Nursing) :- 1.Director of Medical Education - Chairperson 2.Principal, Government Nursing College, Bangalore - Member 3.Assistant Director of Nursing - Member 4.Deputy Director of Medical Education - Member-Secretary For Bachelor of Pharmacy :- 1.Director of Medical Education - Chairperson 2.Principal, Government College of Pharmacy, Bangalore - Member 3.Deputy Director of Medical Education - Member-Secretary The Chairperson also may invite specialist in the field as invitees to assist the Committee. (2) The Selection Committee shall scrutinize all the documents required to be produced by the candidates under these rules and shall record its views in the matter. (3) In all matters under sub-rule (2) above, the decision of the Committee shall, subject to any general or special orders of Government in this regard, be final. 12. Penalties :- Where a candidate or his parents or guardian furnishes false or incorrect marks card or statement of marks or a certificate or an affidavit filed along with the application, such application shall be liable to be rejected and the seat, if any, given to such candidate shall be liable to be forfeited. Such candidates, his parents or guardian, as the case may be, shall also render themselves liable for both civil and criminal action. Where the Director considers that action should be taken under these rules for rejecting an application and forfeiting a seat, he shall pass appropriate orders after holding such enquiry as he deems necessary and after giving reasonable opportunity to the candidate and/or his parents or guardian concerned to make his representation. 13. Determination of fees :- (1) The fee for the courses under these rules for Government and University Colleges and aided institutions shall be fixed by Government by notification. (2) The Government shall constitute a Fee Regulatory Committee (hereinafter referred to as the Committee) consisting of such persons as may specially be specified by notification to examine and suggest the fee structure in respect of unaided professional colleges after taking into consideration social aspects of SC/ST, OBCs, Rural and other economically weaker sections and all other relevant factors into account including the suggestion made by the managements of such colleges. The managements, while proposing the tuition fee shall ensure that it is reasonable and fair without any element of profiteering and otherwise in compliance with the decision of the Hon'ble Supreme Court in T.M.A. Pai Foundation and Others v State of Karnataka and Others. The Committee shall function in accordance with the terms of reference notified by the Government. In recommending the fee, the Committee shall also ensure that the private management make adequate provision for providing financial assistance to the Category I of Government seats. The Government may accord approval for the fee recommended by the Committee with such changes or modifications as it may deem fit. (3) The powers and functions of the Committee and the procedure of the Committee shall be such as may be specified in the notification. 14. Reconciliation Meeting :- After the dosing date for allotment as fixed by the Government is over, a reconciliation meeting regarding the number of unfilled and unallotted seats, shall be held between the Director of Medical Education and the respective colleges. After identifying the vacant seats, notification shall be issued regarding such vacant seats by the Director. Such seats, if any, thereafter shall be filled by the respective colleges, within the date stipulated by the Director. Such reconciliation meeting shall be held at least seven days before the last date of admission fixed by Rajiv Gandhi University of Health Sciences. 15. General :- (1) The concerned institution shall immediately allow all the candidates allotted by the Director to join the course of study in the institution and shall thereafter claim and receive the deposited fee of the candidates concerned from the Director. (2) In case of the refusal by a college to admit the candidate with the admission order issued by the Director, the concerned University to which the college is affiliated, shall enforce the admission order issued under these rules, failing which, the concerned University shall take such action as deemed fit and proper by it against the college concerned by exercising the powers vested in it under the Rajiv Gandhi University of Health Sciences Act, 1994 (Karnataka Act 44 of 1994). (3) All admissions made to and by the colleges shall be subject to approval by the Rajiv Gandhi University of Health Sciences. 16. Repeal and savings :- (1) Karnataka Selection of Candidates for Admission to Pharmacy, Nursing and Physiotherapy Courses Rules, 1994 are hereby repealed. (2) Notwithstanding such repeal anything done or action taken under the repealed rules shall be deemed to have been done or taken under these rules.
