Section 4 Maharashtra Biological Diversity (Amendment) Rules, 2010 [06 March 2010] In exercise of the powers conferred by sub-section (1) of section 63 of the Biological Diversity Act, 2002 (18 of 2003) the Government of Maharashtra make the following Rules further to amend the Maharashtra Biological Diversity Rules, 2008 as follows namely:- 1. Section 1 :- These Rules may be called the Maharashtra Biological Diversity (Amendment) Rules, 2010. 2. Section 2 :- In place of existing Rule 3 (1) of the Maharashtra Biological Diversity Rules, 2008 (hereinafter referred to as the "Principal Rules"), the following shall be substituted namely:- 3. Manner of Selection and appointment of Chairperson- (1) Every appointment of the Chairperson under clause (a) of sub- section (4) of section 22 shall be made by selection of a person who- (i) is eligible, eminent and possess in-depth knowledge and has long experience in the conservation and sustainable use of biodiversity and in matters relating to the equitable sharing of its benefits, (ii) shall not be a serving Government officer and (iii) shall be a Graduate in the science stream. 3. Section 3 :- In place of existing Rule 10 of the Principal Rules, the following shall be substituted namely:- 10. Head Office of the Board- The Head Office of the Board shall be Nagpur. 4. Section 4 :- Sub-rule 4 of Rule 4 in the Principal Rules is included as follows namely:- 4 . (4) Notwithstanding any other provisions of these rules, the State Government, as a special case, may appoint a person above 65 years of age, as the first chairperson. However, such chairperson can hold office upto the age of 70 years and should be otherwise eligible according to the provision of Rule 3 sub-rule 1 of these ru l e s.
