Construction Of References In Enactments, Etc., Or In Instruments SCHEDULE 1 :- SCHEDULE Maharashtra Change Of Short Titles Of Certain Bombay Acts Act, 1980 15 of 1980 [07 August 1980] PREAMBLE An Act to amend certain enactments to change their short titles from "Bombay Acts" to "Maharashtra Acts". Whereas, it is expedient to amend certain enactments to change their short titles from "Bombay Acts" to "Maharashtra Acts", to facilitate their citation in future by more appropriate short titles and clarify their application to the existing Maharashtra State and to make certain consequential and incidental provisions; It is hereby enacted in the Thirty-first Year of the Republic of India as follows :- INTRODUCTION Under the States' Reorganisation Act, 1956, a new State of Bombay was formed from 1st November, 1956 which comprised of territories from the old States of Bombay, Hyderabad, Madhya Pradesh, Saurashtra and Kutch. Again, the Bombay Reorganisation Act, 1960 was passed which came into force from 1st May, 1960, a new State of Gujarat was formed and the residuary State of Bombay continued under the name of Maharashtra. While all changes came into force, the old short titled to the Act continued with the word "Bombay" at the beginning. The reasoning for unchanged short title of Act "Bombay" was that the specific Act with the old short title should not loose its identity and will be easier to locate and for the purpose of interpreting other Acts. But with the passage of time, the short titles of these important Acts have become out of date and prima facie, inappropriate for citation. Therefore, following group of Acts have been made brought upto date with the deletion of the short title "Bombay" and the year of enactment. (i) The Bombay Contingency Fund Act, 1956. (ii) The Bombay Legislative Council (Chairman and Deputy Chairman) and the Bombay Legislative Assembly (Speaker and Deputy Speaker) Salaries and Allowances Act, 1956. (iii) The Bombay Ministers' Salaries and Allowances Act, 1956. (iv) The Bombay Legislature Members' Salaries and Allowances Act. 1956. Short Title :- This Act may be called the Maharashtra (Change of Short Titles of certain Bombay Acts) Act, 1980. 2. Amendment Of Certain Enactments :- The enactments specified in the Schedule are hereby amended to the extent and in the manner mentioned in the fourth column thereof. 3. Construction Of References In Enactments, Etc., Or In Instruments :- Unless the context otherwise requires, any reference to the short title of any of the enactments specified in the Schedule in any other enactment, or in any rules, regulations, by-laws, notifications or orders issued under any enactment, or in any instrument, shall, after the commencement of this Act, be construed as a reference to the short title of that enactment as amended in the fourth column of the Schedule. In section 1, for the words and figures "the Bombay Contingency Fund Act, 1956," the words "the Maharashtra Contingency Fund Act" shall be substituted. 1956 XLVII The Bombay Legislative Council (Chairman and Deputy Chairman) and the Bombay Legislative Assembly (Speaker and Deputy Speaker) Salaries and Allowances Act, 1956. (a) In the long title, for the words "the Bombay Legislative Council" and "the Bombay Legislative Assembly" the words "the Maharashtra Legislative Council" and "the Maharashtra Legislative Assembly" shall, respectively, be substituted. (b) In the preamble, for the words "the Bombay Legislative Council" and "the Bombay Legislative Assembly" the words "the Maharashtra Legislative Council" and "the Maharashtra Legislative Assembly" shall, respectively, be substituted. (c) In section 1, for sub-section (1), the following sub-section shall be substituted, namely :- "(1) This Act may be called the Maharashtra Legislative Council (Chairman and Deputy Chairman) and Maharashtra Legislative Assembly (Speaker and Deputy Speaker) Salaries and Allowances Act." 1956 XLVIII The Bombay Ministers Salaries and Allowances Act. 1956. (a) In the long title, for the words "the Government of Bombay" the words "the Government of Maharashtra" shall be substituted. (b) In the preamble, for the words "the Government of Bombay" the words "the Government of Maharashtra" shall be substituted. (c) In section 1, for sub-section (1), the following sub-section shall be substituted, namely :- "(1) This Act may be called the Maharashtra Ministers Salaries and Allowances Act." 1956 XLIX The Bombay Legislature Members Salaries and Allowances Act. 1956. (a) In the long title, for the words "the Bombay Legislature" the words "the Maharashtra Legislature" shall be substituted. (b) In the preamble, for the words "the Bombay Legislature" the words "the Maharashtra Legislature" shall be substituted. (c) In section 1, for sub-section (1), the following sub-section shall be substituted, namely :- "(1) This Act may be called the Maharashtra Legislature Members" Salaries and Allowances Act." 1956 LII The Bombay Legislature Members (Removal of Disqualifications) Act, 1956. (a) In the long title, for the words "the Bombay Legislative Assembly and the Bombay Legislative Council" the words "the Maharashtra Legislative Assembly and the Maharashtra Legislative Council" shall be substituted. (b) In section 1, for sub-section (1), the following sub-section shall be substituted, namely :- "(1) This Act may be called the Maharashtra Legislature Members (Removal of Disqualifications) Act."
