Power to remove difficulties MAHARASHTRA ELECTRICITY REGULATORY COMMISSION(Specific conditions of Distribution Licence applicable to Brihan Mumbai Electric Supply and Transport Undertaking of Municipal Corporation of Greater Mumbai)Regulations, 2007 No. MERC/TEC/Licence Conditions/BEST Undertaking/630: In exercise of powers under clause (d) of sub-section (2) of Section 181 read with the proviso to section 16 and clause (b) of Section 172 of the Electricity Act, 2003, the Maharashtra Electricity Regulatory Commission hereby makes the following regulations, namely:- 1. Short Title, Applicability, Extent and Commencement :- (1)These Regulations may be called the Maharashtra Electricity Regulatory Commission (Specific conditions of Distribution Licence applicable to Brihan Mumbai Electric Supply and Transport Undertaking of Municipal Corporation of Greater Mumbai) Regulations, 2007. (2)These Regulations shall supercede the previous Licence, clearance or approval granted to Brihan Mumbai Electric Supply and Transport Undertaking of Municipal Corporation of Greater Mumbai under the laws repealed by the Electricity Act, 2003. (3)These Regulations shall extend to the whole of the Area of Supply of Brihan Mumbai Electric Supply and Transport Undertaking of Municipal Corporation of greater Mumbai. (4) These Regulations shall come into force from the date of their publication in the Official Gazette. 2. Definitions :- In these Regulations, unless the context otherwise requires:- (a)"Act" means the Electricity Act, 2003 (36 of 2003) as in force from time to time; (b)"BEST" or "Distribution Licensee" means Brihan Mumbai Electric Supply and Transport Undertaking of Municipal Corporation of Greater Mumbai; (c)"General Conditions" means the General Conditions as specified in the Maharashtra Electricity Regulatory Commission (General Conditions of Distribution Licence) Regulations, 2006, as in force from time to time; Words and expressions used in these Regulations and not defined shall have the meanings assigned to them in the Act or rules and regulations made thereunder. 3. Interpretation :- These Specific Conditions with respect to BEST and the General Conditions of Licence as notified by the Commission shall be deemed to be the conditions of licence of BEST and shall govern its operations of distribution and retail supply of electricity in the area specified herein. 4. Area of Supply :- (1) The Area of Supply within which the Distribution Licensee is authorised to supply electricity is as authorised under "The Bombay Electric License, 1905" dated 6 th June 1905 as amended vide Government of Maharashtra Gazette Notification dated 22 nd July 1994 issued by Industries, Energy and Labour Department, and more particularly delineated upon the map of the Area of Supply (thereon coloured red) and deposited by the Distribution Licensee with the Commission. Accordingly, the description of the area of supply is as under: The City, Town and Island of Bombay, but excluding therefrom every cantonment, fortress, arsenal, factory, dockyard, and camp and every building or place in the occupation of Government for Naval or Military purposes situate within or partly within such area. (2) The Distribution Licensee is authorised to supply electricity to the public for all purposes in accordance with the provisions of the Act. 5. Term of License :- The Distribution Licencee shall be deemed to be a licensee for a period of twenty-five (25) years with effect from June 10, 2003 (i.e., the date of coming into force of the Electricity Act, 2003). 6. Inspection of Specific Conditions and License :- The Distribution Licensee shall make provision for public inspection of these Specific Conditions and its licence, clearance or approval, immediately on the date of notification of these Regulations. 7. Power to amend :- The Commission may, at any time, vary, alter, modify or amend any provisions of these Regulations. Any alteration made to these Regulations shall come into force on the date of the notification and the alteration shall thereafter have effect only in such modified form or be of no effect, as the case may be, so, however, that any such alteration or annulment shall be without prejudice to the validity of anything previously done in pursuance of that alteration. 8. Power to remove difficulties :- If any difficulty arises in giving effect to the provisions of these Regulations, the Commission may, by general or specific order, make such provisions not inconsistent with the provisions of the Act, as may appear to be necessary for removing the difficulty.
