XXXVIII of 1997 Maharashtra State Board Of Technical Education (Amendment) Act, 2005 3 of 2006 [09 January 2006] PREAMBLE An Act further to amend the Maharashtra State Board of Technical Education Act, 1997. WHEREAS it is expedient further to amend the Maharashtra State Board of Technical Education Act, 1997 (Mah. XXXVIII of 1997), for the purposes hereinafter appearing; it is hereby enacted in the Fifty-sixth Year of the Republic of India as follows :- 1. Short title :- (1) This Act may be called the Maharashtra State Board of Technical Education (Amendment) Act, 2005. 2. Amendment of section 35 of Mah. XXXVIII of 1997 :- I n section 35 of the Maharashtra State Board of Technical Education Act, 1997 (Mah. XXXVIII of 1997) (hereinafter referred to as "the principal Act"),- (a) in sub-section (2), for the words "first day of August of the preceding year", the words "last day of April of the preceding year" shall be substituted; (b) for sub-section (5), the following sub-section shall be substituted, namely :- "(5) If the Board has recommended the closure of the affiliated Institution the Government may issue the order for closure." 3. Amendment of section 42 of Mah. XXXVIII of 1997 :- In section 42 of the principal Act,- (a) in sub-section (2), for the words "the Government", the words "the Governing Council" shall be substituted; (b) in sub-section (4), for the words "the Government", the words "the Governing Council" shall be substituted.
