Saving SCHEDULE 1 :- SCHEDULE MINISTRY OF AGRICULTURE, DEPARTMENT OF RURAL DEVELOPMENT ECONOMIC INVESTIGATOR (GRADE II) AND STATISTICAL INVESTIGATOR (GRADE II) RECRUITMENT RULES, 1989 G.S.R. 157, dated 19th February, 19901.- In exercise of the powers conferred by the proviso to Art. 309 of the Constitution, and in supersession of :- (i) Ministry of Rural Development (Group 'C' Posts ) Recruitment Rules, 1982, in so far as they relate to the post of Statistical Investigator (Grade II); (ii) Ministry of Rural Reconstruction, Research Investigator (Grade II) Recruitment Rules, 1969: (iii) Ministry of Works and Housing (Statistical Assistant) Recruitment Rules, 1975; (iv) Ministry of Rural Development, Junior Technical Assistant Recruitment Rules, 1982; and (v) Ministry of Rural Development, Technical Assistant (Rural Credit) Recruitment Rules, 1982; except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Statistical Investigator (Grade II) and Economic Investigator (Grade II), namely :- 1. Short title and commencement :- (1) These rules may be called the Ministry of Agriculture, Department of Rural Development Economic Investigator (Grade II) and Statistical Investigator Recruitment Rules, 1989. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and scale of pay :- The number of the posts in each grade, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule to these rules. The posts existing before the promulgation of these rules which will now be re-designated as Economic Investigator (Grade II) and Statistical Investigator (Grade II) have been listed in the Annexure. As and when considered necessary, the posts may be added to or deleted from this list through an Administrative Order only. 3. Method of recruitment, age limit, other qualifications, etc :- T h e method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in Columns 5 to 14 of the said Schedule. 4. Disqualification :- No person;- (a) who has .entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Initial Constitution :- (1) Subject to the provisions of sub-rule (2) persons appointed in a substantive or officiating capacity to a grade prior to the publication of these Rules in the Official Gazette shall retain the relative seniority already assigned to them and shall be en-bloc senior to all others in that grade. Explanation.- For the purpose of this sub-rule those who are confirmed retrospectively with effect from a date earlier than the publication of these rules shall be considered to be permanent officers of the grade. (2) Permanent officers of each grade shall be ranked senior to persons who are officiating on that grade. 6. Power to relax :- Where the Central Government is of opinion that it is necessary or expedient to do, it may, by order, or reasons to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons. 7. Saving :- Nothing in these rules shall effect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-service men and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
