Saving SCHEDULE 1 :- SCHEDULE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS, DEPARTMENT OF PERSONNEL AND TRAINING, DEPARTMENTAL CANTEEN, GROUP 'C' and 'D' POSTS RECRUITMENT RULES, 1999 1 Received the assent of the President New Delhi, the 11th October, 1999 on G.S.R. 341, and published in the Gazette of India, No. 43, Part II, Sub-section (i) of Section 3, dated October 23, 1999-MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training). G.S.R. 341.-In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the President hereby makes the following rules regulating the method of recrutment to Group 'C' and 'D' posts in the Ministry of Personnel, Public Grievances and Pensions (Department of Peresonnel and Training), Departmental Canteen, namely:- 1. Short title and commencement :- (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Departmental Canteen, Group 'C' and 'D' posts Recruitment Rules, 1999. (2) They shall come into force on the. date of their publication in the Official Gazette. 2. Application :- These rules shall apply to the posts specified in column I of the Schedule annexed to these rules. 3. Number of posts, classification and scale of pay :- The number of the said posts, its classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule. 4. Method of recruitment, age limit, qualifications, etc :- T h e method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in: columns 5 to 14 of the said Schedule. 5. Initial Constitution :- The incumbents of the posts sanctioned in the said Schedule who were declared as Government servants vide Office Order No. 12/5/91-DIR(C) dated 29-1-92, shall be deemed to have been appointed under these rules and the service rendered by them on regular basis shall be taken into account for the purpose of promotion to the . higher post. 6. Disqualifications :- No person,- (a) Who has entered into or contracted a marriage with a person having a spouse living; or (b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person. from the operation of this rule. 7. Power to relax :- Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons. 8. Saving :- Nothing in these rules shall affect reservations. relaxations regarding age limit and other concessions required to be provided for the Scheduled Castes and Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
