AN ACT TO VALIDATE THE APPOINTMENT OF CERTAIN LECTURERS OF ENGINEERING SCHOOLS AND POLYTECHNICS BE it enacted by the Legislature of the State of Orissa in the Fifty-fourth Year of the Republic of India as follows: *. Short Title :- (1) This Act may be called the Orissa Technical Education and Training Service (Validation of Appointment of Lecturers) Act, 2003. 2. Definitions :- In this Act, unless the context otherwise requires,- (a) "Lecturers" means the Lecturers appointed to the Service and working in different Government Engineering Schools and Polytechnics; (b) "Recruitment Rules" means the Orissa Technical Education and Training Service Rules, 1985; and (c) "Service" means the Orissa Technical Education and Training Service. 3. Validation :- (1) Notwithstanding anything contained in the Recruitment Rules, nine Lecturers as specified in the Schedule, who were appointed to the Service on ad hoc basis by the Government and are continuing as such, shall be deemed to have been validly and regularly appointed in the Service with effect from the date of commencement of this Act and no such appointment shall be challenged in any Court of Law merely on the ground that such appointments were made otherwise than in accordance with the provisions of the Recruitment Rules. (2) The Lecturers whose appointments are so validated under Sub section (1) shall be treated as entering into the service from the date of commencement of this Act and their past ad hoc service shall only be counted for the purposes of pension, leave and increment and for no other purpose. (3) The Lecturers whose appointments are so validated under Sub - section(1), shall be enblock junior to the Lecturers who have been appointed to the service in the respective discipline in accordance with the Recruitment Rules prior to the commencement of this Act. (4) The inter se seniority among the Lecturers whose appointments are so validated under Sub-section(1) shall be fixed basing on their date of joining as ad hoc Lecturers. SCHEDULE 1 SCHEDULE I
