Short title, commencement and application :- (1) These rules may be called PAPAIN (Grading and Marking) Rules, 1979. (b) They shall come into force on the date of their publication in the official (c) They shall apply to papain prepared in India from papaya latex of unripe pgyqB finis produced in India. 2. Definitions :- In these rules, unless the context otherwise requires: (1) 'Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India. (b) "Schedule" means a Schedule appended to these rules. Comment Definition of a word in another statute.- It is not only impermissible but, HJBBidwgproas whilst interpreting one Act, to travel beyond the same and apply definities of other Acts except those of General Clauses Act, 1897 or to seek the neillgofawwd used in an Act in the definition clauses of another statute even dnqik 4ofag with cognate matter by the same legislature. It has been so held anih-iMildy way back in Laurence Arthur Adamson v. Melbourne and Metropolitan Board of works [A.I.R. 1929 P.C 181] and Jainarayan Rarnkisan v. Motiram Gangaram [AIR 1949 Nag. 34]. The fallacy of adverting to definitions in other statutes for entirely different purposes can only lead one to greater pitfalls. 3. Grade resignation :- The grade designation to indicate the quality of papain sInMI-aetoot m column 2 of Schedules, II and III. 4. Definitions of quality :- The quality of papain, indicated by the respective grail4fafMtion shall be as set out against each grade designation in columns 2 to 5 of schedules D and m. 5. Grade designation marks :- The grade designation marks shall consist of (i) a design incorporating the number of the certificate of authorisation the word 'Agmark" and the grade approved by the Agricultural Marketing Adviser and resembling the one as set out in Schedule 1; (ii) a label specifying the grade approved by the Agricultural Marketing Adviser and bearing a design consisting of an outline map of India with the word 'AGMARK" and the Figure of the rising sun with words "Produce of India" and resembling the one as set out in Schedule 1. Comment The rule prescribes that the grade designation mark shall consist of a design as set oat in schedule I as approved by the Agricultural Marketing Adviser. 6. Method of marking :- (1) The grade designation mark shall be securely affixed to or printed on each container in a manner approved by the Agri- cultural Marketing Adviser. (2) In addition to the above, the following particulars shall also be clearly and indelibly marked on each container, namely: (a) date of packing in code or plain letter, (b) batch number, (c) net weight, (d) place of packing, (e) any other particulars as required by the Agricultural Marketing Adviser from time to time. (3) An authorised packer may, after obtaining the prior approval of the Agricultural Marketing Adviser, mark his private trade mark on a container in manner approved by the said officer, provided that the private trade mark does not represents quality or grade of papain different from the indicated by the grade designation mark affixed to the container in accordance with these rules. 7. Method of packings :- Papain shall be packed in polythene bottles or packages or galvanised tin in 150 grammes, 500 grammes, I kg, 5 kgs, 10 kgs and 50 Kgs packages, which may invariably be packed either in corrugated boxes or wooden crates or in such other manner as may be approved by the Agricultural Marketing Adviser. 8. Special conditions of certiRcate of authorisation :- In addition to the conditions specified in rule 4 of the General (Grading and Marking) Rules, 1937, the following shall be special conditions of every certificate of authorisation issued for the purpose of these rules, namely:- (1) An authorised packer shall make such arrangements for testing papain as the Agricultural Marketing Adviser may specify by general or special order from time to time. (2) An authorised packer shall provide such facilities as may be necessary for testing to the inspecting officers duly authorised by the Agricultural Marketing Adviser in this behalf. Comment This rule lays down that the certificate of authorisation in addition to conditions laid down in rule 4 of General (Grading and Marking) Rules, 1937, the certificate shall be deemed to include the condition that the authorised packer shall make such arrangement for testing papain as specified by rules and the authorised packer shall provide all facilities necessary for the testing to the Inspecting Officers.
