Short title and application :- (1) These rules may be called the Rice (Grading and Marking) Rules, 1939. (2) They shall apply to rice of specified varieties grown in India as set out in the annexed Schedules. 2. Grade designations :- Grade designations to indicate the quality of rice of specified varieties grown in India are set out in the first column of the relevant Schedules. 3. Definition of quality :- [(1) The rice of all varieties specified in the Schedules annexed to these rules shall consist of well hulled rice in good condition cleaned (sifted), free from paddy and reasonably dry (moisture content not exceeding 13 per cent)]. (2) The special characteristics of quality indicated by the grade designations are set out in columns 2 to 12 of the relevant Schedule. (3) The general characteristics of the quality of the rice of each specified variety are set out in column 13 of the relevant Schedule. 4. Grade designation marks :- The grade designation mark shall consist of label bearing a design (consisting of an outline map of India in conjunction with the word AGMARK) resembling that set out in Schedule I, specifying the grade designation and of the following Colour- 5. Method of marking :- The grade designation mark label shall be securely attached to each container. In addition to the grade designation mark the following particulars shall also be clearly marked on the label- (a) year of harvest. (b) net weight, (c) name of paker, (d) date of packing. 6. Method of packings :- (1) The rice shall be packed in containers made of ju cotton or paper which are clean, dry and in good sound condition. Containers which have been previously used for commodities likely to cause damage or impart a obnoxious flavour, odour or other undesirable characteristics to the rice shall not employed. (2) Each container shall contain only goods of the crop year specified and of grade designation only. Broken grains.Broken grains shall include pieces of kernel which are less than three-fourth of a whole kernel. Fragments. The Fragments shall include pieces of kernel smaller than one-fourth of the whole kernel. Other rices.The tolerances specified in column 11 shall include rice of other varieties. Chalky grains.A Chalky grains shall be a grain of rice one-half or more of which is chalky. For accidental errors a margin of /2, 1 and 1 /2 per cent may be permitted in excess of the tolerance specified in column 3 for special, A and B grades respectively, and a margin of 0.25 per cent. may be permitted in excess of the specified tolerances in each of the columns 2,4,5,6 and 8 in respect of A and B grades only, provided that in every case the total is not in excess of the total refraction specified in column 9. Basis of quantitative determination.All determinations and percentages shall be reckoned on the basis of the total weight of a representative sample. Broken grains.Broken grains shall include pieces of kernel which are less than three-fourth of a whole kernel. Fragments.The Fragments shall include pieces of kernel smaller than one-fourth of the whole kernel. Chalky grains.A Chalky grains shall be a grain of rice one-half or more of which is chalky. Size of grains.The tolerances, specified in column 11 shall be based upon the average of the length of 20 whole kernels (including rices of other varieties). For accidental errors, the following tolerances may be permitted in excess of the tolerances specified in columns 3,4,5,6 and 8 provided that in every case the total refraction does not exceed the proportion specified in column 9: (i) A tolerance of 0.25 per cent in column 3 in respect of Special and A grades and a tolerance of 0.50 per cent in respect of B grade. (ii) A tolerance of 0.05 per cent in column 4 in respect of B grade only. (iii) A tolerance of 0.50 per cent in column 5 in respect of Special and A grades and a tolerance of 1.00 per cent in respect of B grade. (iv) A tolerance of 0.10 per cent in column 6 in respect of Special and A grades and a tolerance of 0.20 per cent in respect of B grade. (v) A tolerance of 0.50 per cent in column 8 in respect of Special, A and B grades. The Fragments shall include pieces of kernel smaller than one-fourth of the whole kernel. Chalky grains.A Chalky grains shall be a grain of rice one-half or more of which is chalky. For accidental errors a tolerance is permissible upto 1 /2, per cent in excess of the tolerances specified in column 3 and a tolerance up to 0.25 per cent. in excess of the specified tolerance in each of the columns 2,4,5,6,7 and 8, provided the total is not in excess of the total refraction specified in column 9. For accidental errors, a tolerance is permissible up to 1 and 1 /2 per cent in excess of the tolerances specific in column 3 for special and A grades respectively, and a tolerance up to 0.5 per cent in excess of the specified tolerance in each of the columns 2,4,5,6,7 and 8 uniformly for the two grades provided the total is not in excess of the total refraction specified in column 9.
