Repeal of Act 21 of 1958 Rice Milling Industry (Regulation) Repeal Act, 1997 28 of 1997 [May 28,1997] An Act to repeal the Rice-Milling Industry (Regulation) Act, 1958 Be it enacted by Parliament in the Forty-eighth Year of the Republic of India as follows:- 1. Short title :- This Act may be called the Rice-Milling Industry (Regulation) Repeal Act, 1997. 2. Repeal of Act 21 of 1958 :- The Rice-Milling Industry (Regulation) Act, 1958 is hereby repealed. NOTES Repeal-Effect of.-When a statute is repealed or comes to an automatic end by efflux of time, no prosecution for acts done during the continuance of the repealed or expired Act can be commenced after the date of its repeal or expiry because that would amount to the enforcement of a repealed or a dead Act. In cases of repeal of statutes this rule stands modified by S. 6 of the General Clauses Act. An expiring Act however is not governed by the rule enunciated in that section. State of U.P. v. Jagamander Das. AIR 1954 SC 683: 1954 Cri LJ 1736. In order to see whether the rights and liabilities under the repealed law have been put to an end by the new enactment the proper approach is not to enquire if the new enactment has by its new provisions kept alive the rights and liabilities under the repealed law but whether it has taken away those rights and liabilities. The absence of a saving clause in a new enactment preserving the rights and liabilities under the repealed law is neither material nor decisive of the question. Javantilal Amrathtal v.
