Website : www.courtkutchehry.com SALT (RESERVE STOCKS) ORDER, 1955 CONTENTS 1. 1 2. 2 3. 3 4. 4 4A. 4A 5. 5 SALT (RESERVE STOCKS) ORDER, 1955 2 -In exercise of the powers conferred by Sec. 3 of the Essential Commodities Act, 1955 (10 of 1955) and in supersession of the notification of the Government of India in the Ministry of Production No. S.R.O. 707, dated the 23rd March, 1955, the Central Government hereby makes the following Order, namely 1. 1 :- (1) This Order may be called the Salt (Reserve Stocks) Order, 1955. (2) It shall come into force on the 1st June, 1955. 2. 2 :- In this Order,- (a) "importer" means a person who imports salt at Calcutta by sea whether from foreign or indigenous sources; (b) "Salt Commissioner" means the Salt Commissioner to the Government of India. 3. 3 :- 1[[ (1) Every importer of salt shall store not less than five per cent. of the quantity of each of the different varieties of salt (that is Kurkutch or Fine) imported by him, in the Government Golah of Calcutta, but the Salt Commisicner may vary, from time to time, the percentage of salt to be stored so, however, as not to increase it above fifteen per cent and in doing so may also, for such period as he may specify require that no further quantity of salt shall be offered by any importer for storage of salt as reserve stock in the Golahs. (2) While varying the percentage of salt to be stored under sub- paragraph (1) the Salt Commissioner shall have regard to the following matters, namely: (a) the quantity of salt imported by the importers, from time to time; (b) the reserve stock of salt available at Government Golahs; (c) any other matter which in the opinion of the Salt Commissioner, is relevant for the purpose.] 2[(a) All importers of salt shall furnish the following particulars to the Assistant Salt Commissioner, Calcutta and the Superintendent of Salt, Government Salt Golahs, Howarh at least 24 hours before the actual commencement of discharge of salt cargo from the vessels, namely: (i) Name of the vessel. (ii) Port of shipment. (iii) Manifested quantity (separately for different varieties, i.e.. Crushed, Uncrushed and Total). (iv) Approximate date and time of commencement of discharge, indicating the name of the Dock or Mooring of Calcutta Port where the vessel will be berthed for discharge. (v) Name and full address of the importer: Provided that if the above particulars are not furnished within the specified time, the Superintendent of Salt, Government Salt Golahs, shall have the power to refuse delivery of large (20 maunds) weighing scales at the time of discharge of salt from the vessel. (b) All importers of salt shall arrange storage of the required quantity of salt in the Government Golahs towards the reserve stock 3[within 72 hours] from the commencement of discharge of salt from the vessel failing which the Salt Commissioner or any other officer duly empowered by him shall have the power in collaboration with the Port, Customs and Shipping authorities, to stop discharge of the remaining quantity of salt from the vessel and the importer concerned shall be required to pay all demurrage and other charges which may accrue due to detention of the vessel. (c) All expenses in connection with the storage of salt in the Government Golahs at Salkia (Howrah) towards the reserve stock (which operation includes unloading from the vessels, loading into boats or other means of conveyance, cost of carriage from the point of discharge from the vessel to the jetties/pontoons along side the Governm ent Golahs, labour charges for unloading from the boats and storage into the allotted Government Golahs at the approved rates payable to the labour contractors in the Government Saltt Golahs, etc.) shall beborne by the importer who shall not claim reimbursement for the same. 4 [The importers shall observe the provisions of the rules regarding the administration of the Salkia Salt Golahs in respect of storage and removal of salt in reserve stock.] 1. Salt (3), dated 6th February, 1979 (w.e.f. 10th March, 1979). 4. 4 :- The quantity of salt stored under para. 3 shall be treated as a reserve and no dealer shall sell or otherwise dispose of such quantity of salt or any part thereof, without the permission in writing of the Salt Commissioner or any officer authorised by him in this behalf. 1 [The reserve stock shall normally be kept for a period of one year but releases may be made from the storage on first come first served basis as soon as the total reserve stock crosses the maximum limit prescribed by the Salt Commisioner, from time to time. The period may, however, be extended by the Salt Commissioner, if the situation so warrants.] 1. Ins. by S.O. 872/Ess. Com. Salt (3). 4A. 4A :- Notwithstanding anything contained in the foregoing paragraphs, the Salt Commissioner may, by order in writing and subject to such conditions as may be specified therein, exempt any shipment of salt which is imported solely for industrial purposes from the provision of this Order.] 5. 5 :- For violation of any of the clauses of this Order, action shall be taken against the importer under Sec. 7 of the Essential Commodities Act, 1955.]
