Conditions for grant of certificate of authorisation SCHEDULE 1 :- SCHEDULE I SCHEDULE 2 :- SCHEDULE II TEJPAT GRADING AND MARKING RULES, 1996 Whereas the draft Tejpat Grading and Marking Rules, 1995 were published as required by Sec. 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) under the notification of the Government of India in the Ministry of Rural Areas and Employment number. G.S.R. 403 dated the 2nd September, 1995 at pages 1892-1897 in the Gazette of India, Part II, Sec. 3, Sub-section (;) inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of forty five days from the date on which the copies of the Gazette containing the said notification are made available to the public. And whereas copies of the said Gazette were made available to the public on the 20th September, 1995; And, whereas no objections and suggestions were received from the public in respect of the said draft rules during the said period by the Central Government; Now, therefore in exercise of the powers conferred by Sec. 3 of the Agricultural Produce (Grading and Marking) Act, 1937, the Central Government hereby makes the following rules, namely : 1. Short-title and application :- (1) These rules may be called the Tejpat Grading and Marking Rules, 1996: (2) These shall apply to Tejpat (Cinnamomum Tamala Nees and Eberm). (3) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions :- In these rules, unless the context otherwise requires, (a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India. (b) "Authorised packer" means a person or a body of persons who has been granted certificate of authorisation to grade and mark Tejpat in accordance with the provisions of these rules; (c) "Certificate of Authorisation" means a certificate issued under the General Grading and Marking Rules, 1988; (d) "Schedule" means a Schedule appended to these rules. 3. Grade designation :- The grade designations to indicate the quality of Tejpat shall be as set out in column 1 of Schedule 2. 4. Definition of quality :- The quality indicated by such grade designation shall be as set out against each grade designation in columns 2 to 9 of Schedule 2. 5. Grade designation marks :- The grade designation mark shall consists of, (i) Agmark lebel shall specify the name of the commodity, grade designation and bearing a design consisting of an outline map of India with word "AGMARK" and figure of the rising sun and resembling the one as set out in Part-1 of Schedule-1, or (ii) "Agmark replica" consisting of a design incorporating the word "AGMARK" the number of the certificate of authorisation, name of the commodity and grade designation resembling the one as set out in Part-11 of Schedule-1: Provided that the use of Agmark replica in lieu of Agmark labels shall be allowed only to such authorised packers who have been granted permission by the Agricultural Marketing Adviser or an officer authorised by him in this regard and subject to the conditions as prescribed under the General Grading and Marking Rules, 1988. 6. Method of packing :- The graded material of the Tejpat shall be packed in new, clean, sound and dry jute bags, polywoven bags, polyethylene, polypropylene or cellophone or paper packs and in other food grade plastic materials or any other packing material that may be approved by the Agricultural Marketing Adviser or any other officer authorised by him in this behalf as per rule 11 of the General Grading and Marking Rules, 1988; (2) The packages shall be free from insect infestation, fungus contamination, deleterious substances and undesirable or obnoxious smell: (3) The net weight of the Tejpat packed in a container shall be 25 gms, 50 gms, 100 gms, 500 gms, I kg and thereafter in multiples of 500 gms as per the Standard of Weights and Measures (Package Commodities) Rules, 1977, as amended from time to time; (4) Each package shall be securely closed and suitably sealed; (5) Each package shall contain Tejpat of one grade designation only. (6) Suitable number of consumer packs containing graded material of the same grade designation and from the same lot may be packed in master container. 7. Method of Marking :- (1) The grade designation mark shall be securely affixed to or clearly and indelibly printed on each packages. (2) In addition to the grade designation mark the following particulars shall be clearly and indelibly marked on the label or on the package : (a) Name of the commodity, (b) Place of packing, (c) Date of packing in month and year, (d) Lot number, (e) Net weight, (f) Price, (g) Name and address of the authorised packer; (3) An authorised packer may after obtaining prior approval of the Agricultural Marketing Adviser or any officer authorised by him in this behalf in accordance with rule 11 of the General Grading and Marking Rules, 1988, and mark and/or affix his private trade mark on the packages. Provided that the private trade mark does not indicate quality or grade of the commodity other than indicated by the grade designation mark affixed to the graded packages in accordance with these rules. 8. Conditions for grant of certificate of authorisation :- I n addition to the conditions specified in sub-rule (8) of rule 3 of the General Grading and Marking Rules, 1988, the following shall be the additional condtions for grant of certificate of authorisation for grading and marking Tejpat under these rules, namely : (a) The authorised packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or any officer authorised by him in this behalf, for testing the quality of Tejpat or has access to any approved laboratory for the purpose; (b) The premises for processing and packing shall be maintained in perfect hygenic and sanitary conditions. (c) The personnel engaged in these operations shall be in sound health and free from any contagious disease. (4) be free from added colouring matter and admixture of leaves other than Tejpat. (5) be in sound merchantable conditions and fit for human consumption in all respects; (6) comply with specifications prescribed under the relevant rules, in case of application on ECO MARK for this commodity; (7) comply with the restrictions in regard to aflatoxin, metallic and other naturally occurring toxic substances contamination, linsecticide residues and other provisions prescreibed under the Prevention of Food Adulteration Rules, 1955. *Non specified : This is not a regular grade but has been provided to meet such specific requirements of the buyer which are not covered under any of the regular grade. This grade shall be allowed for export against a specific order from the foreign buyer indicating the quality and quantity of the produce. Explanations : 1. Extraneous matter-means stones, dust, other dirt and all organic and vegetable matter not of tejpat origin. 2. Damaged, discoloured and shrivelled leaves-means leaves that are damaged or discoou red or not prc iperly developed which materi: ally affect thi i quality, shr ivilled leaves do not include small and tender leaves. 3. Insect board and diseased leaves-means leaves that are partly or wholly bored or eaten by insects or diseased which materially affect the quality. 4. Twings and leaf stalk-mean small branches and stalks attached with the tejpat leaves.
