Saving Usurious Loans (Andhra Pradesh Extension And Amendment) Act, 1961 24 of 1961 [07 September 1961] An Act extend the Usurious Loans Act, 1918 (Central Act 10 of 1918), to certain territories in the State of Andhra Pradesh and further to amend it in its application to that State. Be it enacted by the Legislature of the State of Andhra Pradesh in the twelfth year of the Republic of India, as follows.-- 1. For Statement of Objects and Reasons, see part IV-A of the Andhra Pradesh Gazette dt. 3-9- 1959, p. 144. 1. Short Title :- This Act may be called the Usurious Loans (Andhra Pradesh Extension and Amendment) Act, 1961. 2. Definition :- In this Act, unless the context otherwise requires, "transferred territories" means the territories specified in sub-section (1) of Section 3 of the States Reorganization Act, 1956 (Central Act 37 of 1956). 3. Extension Of Central Act, 10 Of 1918 To Transferred Territories :- The Usurious Loans Act, 1918 (Central Act 10 of 1918) (hereinafter referred to as the principal Act), as in force at the commencement of this Act in the territories which immediately before the 1 st November, 1956, were comprised in the State of Andhra and as amended by this Act, is hereby extended to, and shall be in force in, the transferred territories. 4. Amendment Of Section 1, Central Act 10 Of 1918 :- In Section 1 of the principal Act, for sub-section (2), the following sub-section shall be substituted, namely.-- "(2) It extends to the whole of the State of Andhra Pradesh". 5. Power To Remove Difficulties :- If any difficulty arises in giving effect in the transferred territories to the provisions of the principal Act, the State Government may, by order notified in the Andhra Pradesh Gazette, make such provisions or give such directions not inconsistent with the purposes of that Act, as appear to them to be necessary for the removal of the difficulty. 6. Saving :- Nothing contained in the principal Act as now extended to the transferred territories shall be deemed to limit or otherwise affect any special law relating to relief of indebtedness in force in those territories, and the provisions of the principal Act shall be deemed to be in addition to and not in derogation of the provisions of such special law.
