Whereas it is expedient to amend the West Bengal Apartment Ownership Act, 1972 (West Ben. Act 16 of 1972), for the purposes and in the manner hereinafter appearing: It is hereby enacted in the Fifty-fourth Year of the Republic of India, by the Legislature of West Bengal, as follows :- * The above Act of the West Bengal Legislature received the assent of the Governor and was published in the Kolkata Gazette, Extraordinary, Part III, No. 2186-L dated 30th December, 2003. 1. Short Title And Commencement :- (1) This Act may be called the West Bengal Apartment Ownership (Amendment) Act, 2003. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint. 2. Amendment Of Section 4 Of West Bengal Act 16 Of 1972 :- For subclause (ii) of clause (b) of sub-section (3) of section 4 of the West Bengal Apartment Ownership Act, 1972 (hereinafter referred t o as the principal Act), the following sub-clause shall be substituted:- (ii) execute and register an instrument in such form, accompanied by such fee, and in such manner and within such period as may be prescribed, undertaking to comply strictly with the bye-laws arid with the covenants, conditions and restrictions as set forth in the Declaration referred to in section 2.". 3. Amendment Of Section 10 :- In sub-section (1) of section 10 of the principal Act, for the words The Declaration referred to in Section 2 shall be submitted in such form and in such manner as may be prescribed", the words The Declaration referred to in section 2 shall be submitted in such form, accompanied by such fee and in such manner as may be prescribed," shall be substituted.
