This case has been taken up through Video Conferencing via Webex facility in the light of Pandemic Covid-19 situation and as per instructions.

Prayer in the instant application is for withdrawal of the main appeal.

Application is supported by an affidavit dated 24.11.2020 of the Manager, National Insurance Company Ltd., Sector 34-A, Chandigarh/appellant-

company.

In the light of the prayer made in the application the main appeal which otherwise stands admitted is taken up on board today itself.

Application disposed of.

Main case

Instant appeal was preferred at the hands of the National Insurance Company Ltd.

The appeal was admitted on 24.07.2013 on the question of liability of the insurance/appellant-company vis-a-vis the employer/respondents No.4 and 5.

Counsel submits that the amount of compensation awarded by the Workmen's Compensation Commissioner, Kurukshetra already stands released in

favour of the claimants. Mr.Rajneesh Malhotra, Advocate makes a statement at the bar that he has instructions from the appellant-insurance company

to withdraw the appeal.

Under such circumstances there would be no requirement of issuing notice to the opposite side insofar as withdrawal of the appeal is concerned.

As per statement made by counsel, appeal is disposed of as withdrawn.
