1. Heard.

2. The issue relates to mutation of the name of respondent No.4 in the revenue record pertaining to the land bearing Khasra No.15 area 8.371

hectares, Village Palari, Tehsil Balodabazr, District Raipur.

3. Admittedly, Civil Suit No.15A/02 is pending before the Second Additional District Judge, Baloda Bazar, wherein, the issue of title shall be

adjudicated by the trial Court.

4. Needless to say, based upon the outcome of the Civil Suit, the entries in the revenue record would be corrected and the same shall have

precedence over the order passed by the Board of Revenue.

5. In the above circumstances, on account of pendency of the aforesaid civil suit, the writ petition is disposed of with observation that the impugned

order passed by the Board of revenue shall remain subject to final order passed by the trial Court in Civil Suit No.15A/02.

6. The trial Court at Baloda Bazar is directed to decided the civil suit between the parties within a period of 3 months from today.

7. A copy of this order be sent forthwith to the trial Court at Baloda Bazar.

8. The Additional Registrar (Judicial) shall also inform the trial Court about this order.
