Sh. S.A. Saud, ld. counsel for the respondent no. 2, during the course of hearing, submitted that in the matter of FMAT 36/2001 (CAN 1/2021)
pending before the Hon’ble High Court of Calcutta, the argument is part heard and has been adjourned to 24th February, 2021 for further hearing.
It is contended by the ld. counsel for the respondent no. 2 that the matter is still under the seisin of the Hon’ble High Court of Calcutta so, the
appeal may be taken up after 24th February, 2021.
The ld. counsel for the corporation bank submitted that in the previous order dated 03rd February, 2021 there was no mention of the details of the case
filed by the respondent no. 2 and pending before Hon’ble High Court of Calcutta as a result of which the bank could not move the Hon’ble
High Court of Calcutta and participate in the proceedings.
On this, the ld. counsel for the respondent no. 2 submitted that all the parties herein have been made parties before the Hon’ble High Court, the ld.
counsel for the bank may contact the concerned office of the bank.
The attention of the ld. counsel for the bank is drawn to the last order dated 03.02.2021 passed by this Tribunal. In the second para of the said order
the case no. and interim application no. have been clearly mentioned. The ld. counsel should have read the entire order dated 03.02.2021 before
making any such submission.
With the consent of the parties, list the matter on 26th February, 2021 at the end of the board. The matter would be taken up at 12.00 pm.
