1. Petitioner is wife of late Gurdayal Singh, who was a registered Contractor with Irrigation Department and was awarded work of repair and
maintenance of Irrigation Canals by respondent no.3.
2. According to the petitioner, her husband had completed the work to the satisfaction of the concerned authorities, but the payment due for the said
work has not been released to the petitioner.
3. By means of this writ petition, petitioner has sought the following reliefs:-
“i) Issue a writ, order or direction in the nature of mandamus, directing the respondent authorities to make the payment of the petitioner due to her
(As shown in Annexure no. 1 to the Writ Petition), as the work has been completed under the 7 Contract Bonds).
OR
Issue a writ, order or direction in the nature of mandamus, directing the respondent authorities may decide his representation dated 18.05.2021.â€
4. Learned Deputy Advocate General for the State assures the Court that admitted dues of the petitioner, if any, shall be released to her as early as
possible. He further submits that let petitioner submit a representation to the Competent Authority so that the Competent Authority will be in a position
to ascertain the amount payable to the petitioner.
5. Accordingly, writ petition is disposed of with liberty to the petitioner to make fresh representation to respondent no.3 within ten days from today. If
such representation is made within stipulated time, respondent no.3 shall look into the matter and take appropriate decision, in accordance with law as
early as possible, but not later than six months from the date of receipt of representation along with certified copy of this order.
