Judge, Fast Track Court, Ropar, whereby, the revision petition filed by the Petitioner challenging the orders dated 02.03.2009 passed by JMIC,
Ropar had charged the accused u/s 304A IPC, FIR No. 32 dated 09.07.1993 registered at Police Station Chamkaur Sahib instead of Section
302 IPC, has been dismissed.
2. Revision petition filed by the Petitioner is dismissed by the Court below. Second revision is not maintainable. The present petition has been filed
u/s 482 Code of Criminal Procedure Second revision under the garb of Section 482 Cr.P.C can be entertained only on account of any miscarriage
of justice. Even otherwise, in the facts of the present case, the Petitioner has not been able to show as to how the offence u/s 302 IPC is attracted.
Paramjit Singh is stated to have died and accidentally killed in cross firing between the police and terrorists.
3. Accordingly, no ground to interfere in the order dated 14.09.2010 passed by the Additional Sessions Judge, Fast Track Court, Ropar, vide
which, revision petition qua order framing charges u/s 304A IPC has been dismissed.
Dismissed.
