1. For the reasons stated in the application, the same is allowed and disposed of.

CWP No.7759 of 2021

With consent of learned counsel for the parties, the matter is heard at this stage.

2. This writ petition has been filed for the grant of following substantive reliefs:-

“(a). That respondents may kindly be directed to release revised pay scale of Rs.10300-34800+ Grade pay to the petitioners from their initial date

of appointment as TGT on contract basis or directions be issued to the respondent to extend the benefit of revised pay scale on the analogy of the

Judgment passed in LPA 105/2010.

(b). That respondent may be directed to release the exceed/balance amount in favour of petitioners in term of arrears after revision of scale on the

analogy of LPA 105/2012.â€​

3. During hearing of the case, learned counsel for the petitioners submitted that the case of the petitioners vis-Ã -vis reliefs claimed by them is

squarely covered by the judgment dated 13.12.2012 passed in a bunch of matters with lead case LPA No.105/2010 (The State of Himachal Pradesh

and others Versus Rakesh Chand and others). Learned counsel further submitted that the petitioners would be content in case a direction is issued to

the respondents/competent authority to consider and decide the case of the petitioners for redressal of their grievances raised in the writ petition in

light of the aforesaid judgment within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer.

4. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of by directing the respondents/

competent authority to consider and decide the case of the petitioners for redressal of their grievances raised in the writ petition, in accordance with

law and taking into consideration the above judgment in the case of Rakesh Chand, supra, within a period of six weeks from today. The decision so

arrived at shall also be communicated to the petitioners.

The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
