1. The present Criminal Petition is filed on behalf of Accused No.3 in C.C.No.538 of 2012 on the file of the Judicial First Class Magistrate, Mylavaram, seeking to quash the proceedings pending against him.

2. Today, when the matter is taken up for hearing, the learned counsel appearing for the 2nd respondent as well as the learned Assistant Public Prosecutor state that the trial of the case was already commenced and 313 Cr.P.C., examination has also been completed.

3. In view of the above statement made by the learned counsel for the 2nd respondent as well as the learned Assistant Public Prosecutor, this Court is inclined to close the present Criminal Petition as the trial of the case was already commenced and prosecution side evidence was closed.

4. Accordingly, the Criminal Petition is closed while granting liberty to the petitioner to participate in the trial of the case.

Miscellaneous applications pending, if any, shall stand closed in consequence.
