Judgement

When the matter was called out, the learned counsels for the parties have appeared.

Petitioner is an accused for the offence under section 306 of the Indian Penal Code.

The learned counsel for the petitioner submits petitioner has come up again as earlier bail application of the petitioner was rejected vide order dated

21.08.2023 passed by this Court in BA No. 5610 of 2023 and, therefore, he has spent additional period in custody which may be considered. The

learned counsel for the petitioner further reiterates the grounds which he had taken on earlier occasion and submitted that the petitioner has in no way

abetted the deceased to commit suicide. He further submits that when the informant was narrating to his wife about rejection of the petitioner to

marry their daughter, the deceased heard the same and committed suicide. The learned counsel for the petitioner has attached the necessary

documents to prove the authenticity of the petitioner being in Dubai from 30.10.2020 to 26.12.2022 and submits that when the petitioner was away for

such a long time, it is impossible to believe that any close intimacy could be developed. Therefore, the petitioner may be released on bail.

Learned counsel for the State has opposed the bail and submits that there was relationship between both the parties and the petitioner refused to

marry the deceased, consequently, the deceased committed suicide.

Having heard learned counsels for the parties and in the facts and circumstances of the case, I am inclined to release the petitioner, named above, on

executing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand Only) with two sureties of the like amount each to the satisfaction of the learned

Additional Sessions Judge-V, Palamau at Daltonganj, in connection with Nawa Jaipur PS Case No. 02 of 2023, corresponding to GR Case No. 739 of

2023, (ST case No. 297 of 2023), subject to the conditions that (i) the petitioner shall attend each and every date of trial unless it is dispensed with by

the learned court below and, (ii) the petitioner shall submit self-attested photocopy of his Aadhar Card and mobile number before the learned court

below which he will always keep active and will not change it during pendency of the case without prior permission of the Court.
