This fourth application for bail under Section 439 Cr.P.C. has been filed by the petitioner who has been arrested in connection with FIR No.58/2019
registered at Police Station Deedwana, for offences under Sections 149, 341, 323, 365 and 302 IPC.
Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.
Having considered the arguments advanced at the Bar, facts and circumstances of the case, this Court prima facie finds that this is fourth bail
application and there is no change in circumstance warranting fresh consideration of the present bail application on merits.
Thus, looking to the seriousness of the accusation against the petitioner coupled with the fact that the petitioner has not brought forward any
circumstance which would convince the Court otherwise that the petitioner is not involved in commission of alleged crime, this Court is not inclined to
enlarge the petitioner on bail.
Accordingly, the instant fourth bail application under Section 439 Cr.P.C. preferred by the petitioner is dismissed.
It is, however, expected from the competent criminal court that the trial pending against the petitioner would be concluded expeditiously.
