S.B. Criminal Miscellaneous Interim Bail Application No. 1003/2024 :

The petitioner has been arrested in connection with F.I.R. No. 347/2017, Police Station Rajgarh, District Churu for the offences punishable under Sections 148, 302 read with Section 149 IPC. He has preferred this interim bail application under Section 439 of Cr.P.C. on the ground of his illness.

Heard learned counsel for the parties. Perused the material on record.

Learned counsel for the petitioner submits that the petitioner is facing acute problem in his spinal code and the same is required to be operated. He further submits that the necessary medical documents have been placed on record which show that the petitioner is required to be operated. Learned counsel further submits that the petitioner was enlarged on interim bail on third occasions and he has surrendered before the Jail Authorities on time as ordered by this Court. Therefore, he may be enlarged on interim bail for a period of two months.

Learned public prosecutor has verified the factum of petitioner suffering from ailment in his spinal code/backbone and the same is required to be operated at higher centre.

Having regard to the totality of the facts and circumstances of the case and considering the prayer of the petitioner and the medical documents as well as the verification report submitted by learned public prosecutor, this Court deems it just and proper to grant interim bail to the petitioner under Section 439 of Cr.P.C. for a period of two months.

Accordingly, the interim bail application filed under Section 439 of Cr.P.C. is allowed and it is directed that petitioner -Ravindra @ Mintiya S/o Shri Jale Singh shall be released on interim bail for a period of 60 days (sixty days) from the date of his actual release from prison in connection with F.I.R. No. 347/2017, Police Station Rajgarh, District Churu, provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees: Fifty Thousand Only) along with two sureties of Rs.25,000/-(Rupees: Twenty Five Thousand Only) each to the satisfaction of the concerned Jail Superitendent on usual conditions. The concerned Jail Superintendent shall be at liberty to impose any other usual terms and conditions for surrender of the petitioner. He shall also give the date for surrender of the petitioner after expiry of the period of 60 days (sixty days) from the date of his actual release from prison.

S.B. Criminal Misc. Appli No. 2/2024 :

Learned counsel for the petitioner submits that he wants to withdraw the present misc. application.

Accordingly, the misc. application is dismissed as withdrawn.
