This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application filed by the petitioner for grant of interim bail on the ground of attending the obsequies ceremony of his elder brother, who passed away on 27.03.2024, and therefore, the presence of the petitioner is very much necessary. The document relating to the death of the elder brother of the petitioner has been annexed to the interim application.

Learned counsel for the State has obtained written instruction from the Inspector-in-charge, Aska Police Station dated 02.04.2024, which indicates that the averments taken in the interim application are correct. The written instruction is taken on record.

Considering the submissions made by the learned counsel for the respective parties and the instruction received, I am inclined to release the petitioner on interim bail for a period of two weeks from today.

Let the petitioner be released on interim bail for the aforesaid period to the satisfaction of the learned trial Court in connection with S.T. No.15 of 2023 of the Court of learned Addl. Sessions Judge, Aska on furnishing bail bond of Rs.50,000.00 (rupees fifty thousand) with two solvent local sureties each for the like amount to his satisfaction with further terms and conditions as the learned Court may deem just and proper.

Violation of any of the conditions shall entail cancellation of bail.

Accordingly, the I.A. is disposed of.

The learned trial Court shall not insist for production of certified copy of this order by the petitioner and shall act upon the downloaded copy of this order from this Court’s Website. However, the petitioner shall give an undertaking before the learned trial Court to the effect that he will produce the certified copy of this order on or before 9th April, 2024.

Issue urgent certified copy as per Rules in course of the day.

CRLA No.61 of 2024

List this matter in the week commencing from 22nd April 2024.

 Learned counsel for the appellant shall file the surrender certificate of the appellant by the next date.
