The instant matter is taken up today for admission hearing.
This is the second writ petition on the same cause of action. The earlier writ petition, being WP(C). No. 362 of 2023 is being taken up together with the instant writ petition for hearing. Apart from reiterating the contentions made in the earlier writ petition, the writ petitioner has placed additional grounds to assail the impugned termination order.
On hearing the parties and examination of the materials on record, it appears that the matter needs further hearing, apart from the point of maintainability.
Accordingly, the instant matter is admitted for hearing. As the respondents have only filed affidavit on the ground of maintainability, they are permitted to file a detailed affidavit within two weeks.
List this matter on 17-05-2024.
It is made clear that the question on maintainability is still kept open.
