Judgement

1. The present writ petition has been filed for issuance of direction upon the concerned State respondents restraining the respondent no.5-Rajkumar

Singh from playing loudspeaker and D.J. (Disc Jockey) in high pitch as the said respondent repeatedly spreads noise pollution in the locality.

2. Learned counsel for the petitioner submits that the petitioner is the resident of village-Naina Tand, P.O.-Tenughat, P.S. Gomiya (O.P. Tenughat)

and is the wife of Shri Ranjit Kumar Singh, who is presently serving in the Indian Army as “Subedarâ€. It is further submitted that the respondent

no.5 is the neighbour of the petitioner who invariably plays loudspeaker and D.J. (Disc Jockey) in high pitch i.e., more than restricted limit of sound

i.e., 45 DB in the night and 55 DB in the day hours. It is also submitted that playing of loudspeaker and D.J. (Disc Jockey) in high pitch causes noise

pollution in the area where the petitioner resides. The petitioner has represented various authorities including the respondent no.3-the Deputy

Commissioner, Bokaro in this regard, however, the same have remained un-responded which has compelled her to prefer the present writ petition.

3. Mrs. Moushmi Chatterjee, learned A.C. to G.A.-V appearing on behalf of the respondent-State submits that if the petitioner brings the aforesaid

fact to the notice of the respondent no.3, an appropriate steps, in accordance with law, will be taken within a time frame.

4. Having heard learned counsel for the parties and considering the nature of the grievance raised by the petitioner in the present writ petition, without

entering into the merit of the case, the petitioner is given liberty to prefer a fresh representation on the present issue before the respondent no.3. On

receipt of the said representation, the respondent no.3, after providing an opportunity of hearing to the petitioner as well as the respondent no.5 and

any other concerned person, shall take appropriate steps in accordance with law within a period of six weeks from the date of filing of the

representation.

5. The writ petition is, accordingly, disposed of with aforesaid liberty and direction.
