1. Present C528 application has been filed by the applicants along with the Compounding Application (IA/1/2025) for quashing the charge-sheet dated
27.04.2023, summoning order dated 03.10.2024 as well as the entire proceedings of Criminal Case No. 1982 of 2024, State Vs. Aalok Dwivedi &
others (Case Crime No.37 of 2022), under Sections 147, 148, 323, 504 and 506 of IPC, pending before the court of learned Judicial Magistrate IIIrd,
District Haridwar on the basis of compromise entered into between the parties.
2. Along with C528 application, a joint compounding application (IA No.1/2025) has also been moved by the parties, supported by their separate
affidavits. It is stated in the compounding application that applicants and the private respondents are neighbours who have settled the dispute with the
interference of responsible people of society for maintaining peace and harmony in the society and the private respondents do not want to pursue with
the present case, in view of the compromise entered into between them.
3. Today applicant no.1 (Aalok Dwivedi), applicant no.2 (Sunil Saini @ Sunil Kumar), applicant no.3 (Rohit Negi), applicant no.4 (Pankaj Chauhan),
applicant no.5 (Manoj Negi @ Manoj Bhatt) and applicant no.6 (Shagun) and respondent no.2 (Mohammad Arbaz), respondent no.3 (Nazar Hasan
Ansari), respondent no.4 (Abdul Salam), respondent no.5 (Shahid @ Sajid), are present before this Court duly identified by their respective Advocates.
4. Since the parties have entered into compromise, therefore, there is no useful purpose for keeping this criminal case pending and it will be a futile
exercise to ask the applicants to appear before the trial court as accused to face the trial.
5. Accordingly, the compounding application (IA No.1/2025) is allowed in terms of the compromise entered into between the parties terms whereof
have been narrated in the compounding application.
6. Consequently, the summoning order dated 03.10.2024 as well as the entire proceedings of Criminal Case No. 1982 of 2024, State Vs. Aalok
Dwivedi & others, under Sections 147, 148, 323, 504 and 506 of IPC, pending before the court of learned Judicial Magistrate-IIIrd, District Haridwar
are hereby quashed. Resultantly, the FIR dated 18.03.2022, pursuant to which charge sheet dated 27.04.2023 filed also stand quashed.
