1. This writ petition is filed under Article 227 of the Constitution of India by the petitioner, seeking the following reliefs:-

“(i) To issue a writ, order or direction in the nature of mandamus commanding the respondent no.1 to expedite the proceedings of Misc. Case No.64 of 2018-19 in Original Suit No.2094/06-07 (Old No.1975 of 2004) Gaurav Goyal Vs. Shashank Sharma and others, pending in the court of Tehsildar, Vikas Nagar, Dehradun and to decide the same within the time bound period as may be fixed by this Hon’ble Court.”

2. It is contended by learned counsel for the petitioner that Mutation Case No. 64 of 2018-19 (Old No. 1975 of 2004), Gaurav Goyal vs. Shashank Sharma and others, is pending in the court of Tehsildar, Vikas Nagar.

3. Learned counsel for the State has drawn the attention of this Court to the fact that the proceedings have been delayed by the petitioner himself by approaching different forums, and therefore the mutation proceedings could not be decided earlier.

4. Be that as it may, after exhausting all forums, the petition is pending before the Tehsildar, Vikas Nagar, Dehradun, for a long time. The petitioner has the right to speedy justice, which is a fundamental right.

5. Accordingly, the writ petition stands disposed-off with a direction to the Tehsildar, Vikas Nagar, Dehradun, to decide Misc. Case No. 64 of 2018-19 in Original Suit No. 2094/06-07 (Old No. 1975 of 2004), Gaurav Goyal vs. Shashank Sharma and others, within a period of three months from the date of production of a certified copy of this order.
