Heard Mr. A.S. Siddiqui, learned Senior counsel appearing for the petitioners and also Mr. A. Khan, learned counsel appearing for the respondent.
By this petition, the petitioners have made a prayer for expeditious disposal of the Title Suit No.49 (T) of 2016 pending in the learned Court of Assistant to Deputy Commissioner at Shillong.
The brief fact of the case is that because of existing dispute with regard to the purchase and sale of a property covered by Patta No.18 of 2009 issued by the Syiem of Mylliem, the respondent instituted a Title Suit No.49 (T) of 2016 against the petitioners. Upon receipt of notice, the petitioners filed their written statement and show cause on 04.04.2017 together with a petition under Order XIV Rule 2(2) read with Section 151 of the Code of Civil Procedure, 1908, for framing a preliminary issue with regard to the maintainability of the suit. Accordingly, the learned Trial Court framed the preliminary issue on 04.04.2017 and posted the case for hearing on the question of maintainability on 02.05.2017. However, even after lapse of more than nine years, the suit has not proceeded at all. Faced with the situation, the petitioners have approached this Court for a direction for speedy disposal of the matter.
Mr. A. Khan, learned counsel appearing for the respondent has no objection to the prayer made in this petition.
In view of the above, this civil revision petition is disposed of with a direction to the learned Assistant to the Deputy Commissioner, Shillong, to dispose of the Title Suit No.49(T) of 2016 as expeditiously as possible without any unnecessary delay.
