Heard both the sides.
This bail application filed on behalf of the Ram Shrestha Paswan @ Ram Shrashth Paswan who is in custody since 07.01.2024 in connection with C.I.D P.S. Case No. 06 of 2024 corresponding to NDPS Case No. 62 of 2024 (N) for the offence registered under Sections 15, 18, 22, 27, 27A, 29 of the NDPS Act, 1985 pending in the Court of learned A.J.C. XVIII cum Spl. Judge, CID, Ranchi is pressed into motion.
As per the FIR, 1491.450 kg of Doda packed in 74 sacks was concealed in truck with sacks of rice which was seized by police. Petitioner was driving the said truck at the time of the said seizure.
It is submitted by the learned counsel on behalf of petitioner that he is driver by occupation and was unaware about the presence of narcotics consignment loaded on the truck and he is in custody for two years.
Learned A.P.P. vehemently opposed the prayer for bail and submitted that matter involves huge commercial quantity which was being transported by concealing the same in the truck which could not have been possible without the complicity of the driver.
In view of the commercial quantity of drugs and prima facie materials against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected..
