1. They are heard and the case-diary is perused.

2. This is the first application filed by the applicant under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail. The applicant is apprehending her arrest in connection with FIR / Crime No.127/2024 registered at Police Station - Taal, District -Ratlam for commission of offences punishable under Section 3, 4, 5, 6, & 7 of the Immoral Traffic (Prevention) Act.

3. As per case of prosecution, the police received a discrete information that some illegal activity relating to immoral trafficking is going on. Acting on the said information, the police party reached on spot and arrested some persons namely Meharban Singh and Rakesh. After seeing the policy party, the present applicant jumped from the window due to which she sustained grievous injuries on head, neck and legs. Thereafter, the police admitted her in the hospital. Some objectionable articles were also seized by the police.

4. Learned counsel for the applicant submits that the present applicant is innocent and has falsely been implicated in this crime. The present applicant was released by the police on a notice under Section 41-A of the Code of Criminal Procedure, 1973, thereafter, the police filed the charge-sheet and the the she was declared absconded by the trial Court by issuing perpetual warrant of arrest. The applicant will not flee from justice and co-operate with the Investigating Officer. In such circumstances, a prayer has been made that present applicant be enlarged on anticipatory bail.

5. Learned Government Advocate for the respondent / State has opposed the application and prayed for its rejection.

6. Considering the totality of the facts and circumstances of the case and without expressing any opinion on the merits, the application filed by the application is hereby allowed.

7. It is directed that in the event of arrest, applicant - Kanku Bai @ Mankunwar shall be released on bail, upon her executing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with a solvent surety in the like amount to the satisfaction of the Arresting Officer (Investigating Officer).

8. The applicant shall further abide by the other conditions enumerated in Sub-section (2) of Section 438 of the Code of Criminal Procedure, 1973.

9. M.Cr.C. stands allowed & disposed of. Certified copy, as per Rules.
